AB801,1,3 1An Act to repeal 20.235 (1) (gm); and to repeal and recreate 39.38 (2) of the
2statutes; relating to: Indian student assistance grants and making an
3appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the higher educational aids board (HEAB) administers an
Indian student assistance grant program which provides grants, based on financial
need, to Indian students who are state residents for full-time or part-time
attendance at accredited higher educational institutions in this state. The
maximum grant award under the program is $2,200 per year.
Current law eliminates HEAB effective July 1, 1996, and transfers all functions
of HEAB to the department of education. Also effective July 1, 1996, the state's
maximum grant amount per year under the Indian student assistance grant
program is decreased from $2,200 to $1,100, but this amount may be matched by a
contribution from a federally recognized American Indian tribe or band in this state
for a maximum grant award of $2,200.
This bill eliminates the changes to the Indian student assistance grant program
effective July 1, 1996, thereby maintaining the state's maximum grant amount
under the program of $2,200 per year and eliminating the matching contribution
from a federally recognized American Indian tribe or band in this state.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB801, s. 1 4Section 1. 20.235 (1) (gm) of the statutes, as created by 1995 Wisconsin Act

, is repealed.

1Section 2. 39.38 (2) of the statutes, as affected by 1995 Wisconsin Act 27,
2section 1887g, is repealed and recreated to read:
AB801,2,123 39.38 (2) Grants under this section shall be based on financial need, as
4determined by the department. The maximum grant shall not exceed $2,200 per
5year. Grants shall be awarded to students for full-time or part-time attendance at
6any accredited institution of higher education in this state. The department may not
7make a grant under this section to a student if the department receives a certification
8under s. 46.255 (7) that the student is delinquent in child support or maintenance
9payments. Grants shall be renewable for up to 5 years if a recipient remains in good
10academic standing at the institution that he or she is attending. The American
11Indian language and culture education board shall advise the department on the
12allocation of grants to students enrolled less than half-time.

AB801,2,18 14(1) Tuition grants. In the schedule under section 20.005 (3) of the statutes for
15the appropriation to the department of education under section 20.235 (1) (b) of the
16statutes, as affected by the acts of 1995, the dollar amount is decreased by $237,000
17for fiscal year 1996-97 to decrease funding for the purposes for which the
18appropriation is made.

20of the statutes for the appropriation to the department of education under section
2120.235 (1) (fb) of the statutes, as affected by the acts of 1995, the dollar amount is
22increased by $756,900 for fiscal year 1996-97 to increase funding for the purposes
23for which the appropriation is made.

120.235 (1) (fc) of the statutes, as affected by the acts of 1995, the dollar amount is
2decreased by $3,000 for fiscal year 1996-97 to decrease funding for the purpose for
3which the appropriation is made.

5statutes for the appropriation to the department of education under section 20.235
6(1) (fd) of the statutes, as affected by the acts of 1995, the dollar amount is decreased
7by $58,100 for fiscal year 1996-97 to decrease funding for the purpose for which the
8appropriation is made.

10(3) of the statutes for the appropriation to the department of education under section
1120.235 (1) (fe) of the statutes, as affected by the acts of 1995, the dollar amount is
12decreased by $373,100 for fiscal year 1996-97 to decrease funding for the purpose for
13which the appropriation is made.

18of 1995, the dollar amount is decreased by $56,100 for fiscal year 1996-97 to decrease
19funding for the purpose for which the appropriation is made.
AB801,3,24 20(2) Lawton minority undergraduate grants. In the schedule under section
2120.005 (3) of the statutes for the appropriation to the Board of Regents of the
22University of Wisconsin System under section 20.285 (4) (dd) of the statutes, as
23affected by the acts of 1995, the dollar amount is decreased by $29,600 for fiscal year
241996-97 to decrease funding for the purpose for which the appropriation is made.
