AB803,1,3 1An Act to amend 346.505 (3) (b) (intro.); and to create 346.505 (3) (b) 4. and
2346.505 (3) (d) 3. of the statutes; relating to: parking reserved for vehicles used
3by physically disabled persons.
Analysis by the Legislative Reference Bureau
Under current law, only vehicles that display special license plates or a special
identification card issued to a physically disabled person are authorized to use
parking spaces reserved for the physically disabled (disabled parking space). A
member of an official disabled parking enforcement assistance council (council
member) who sees an unauthorized vehicle parked in a disabled parking space may
prepare a written report of the violation. A report may, within 24 hours after the
violation, be submitted to a traffic officer. The traffic officer may, within 48 hours
after receiving a completed report and investigating the report, issue a parking ticket
to the owner of the vehicle. The vehicle owner may be required to forfeit not less than
$50 nor more than $300.
Under this bill, any person who sees an unauthorized vehicle parked in a
disabled parking space may prepare and submit a report of the violation to a traffic
officer. If the person who submits the report is not a council member, the report must
include a photograph showing the unauthorized vehicle parked in a disabled parking
space. A traffic officer who receives a completed report must issue a parking ticket
to the owner of the vehicle or provide the person who submitted the report with
written notice explaining why a parking ticket was not issued.

enact as follows:

1Section 1. 346.505 (3) (b) (intro.) of the statutes is amended to read:

3council under s. 349.145 or any other person who observes a violation of sub. (2) may
4prepare a written report indicating that a violation has occurred. The report shall
5contain the following information:

8that constitutes evidence of the violation. This subdivision does not apply to a

AB803, s. 3 10Section 3. 346.505 (3) (d) 3. of the statutes is created to read:
AB803,2,1611 346.505 (3) (d) 3. A traffic officer who receives a report containing all of the
12information in par. (b) and does not prepare a uniform traffic citation as provided in
13subd. 1. shall immediately provide the person who prepared the report with written
14notice stating the reason for not preparing a citation. This subdivision does not
15require a traffic officer to provide notice to a member of a disabled parking
16enforcement assistance council.
