AB927,1,3 1An Act to amend 30.12 (4) (a) of the statutes; relating to: interdepartmental
2coordination of certain environmental protection measures applicable to
3transportation projects.

Under current law, no permit is required from the department of natural
resources (DNR) for highway and bridge work that is directed and supervised by the
department of transportation (DOT) that involves the placement of structures or the
deposition of material in navigable waters of this state if the work is accomplished
in accordance with interdepartmental liaison procedures established by DOT and
DNR for minimizing the adverse environmental impact, if any, of the work.
This bill exempts any transportation project directed and supervised by DOT
from having to obtain a permit from DNR to place structures or deposit material in
navigable waters if the transportation project is accomplished in accordance with the
interdepartmental liaison procedures.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB927, s. 1 4Section 1. 30.12 (4) (a) of the statutes is amended to read:
AB927,2,75 30.12 (4) (a) Activities affecting waters of the state as defined in s. 144.01 that
6are carried out under the direction and supervision of the department of
7transportation in connection with highway and, bridge or other transportation

design, location, construction, reconstruction, maintenance and repair are
2not subject to the prohibitions or permit or approval requirements specified under
3this section or s. 29.29, 30.11, 30.123, 30.195, 30.20, 59.971, 61.351, 62.231, 87.30 or
4ch. 144 or 147. However, at the earliest practical time prior to the commencement
5of these activities, the department of transportation shall notify the department of
6the location, nature and extent of the proposed work that may affect the waters of
7the state.
