AB966,1,2 1An Act to amend 196.745 (1) of the statutes; relating to: facilities for the
2production, transmission or distribution of gas.
Analysis by the Legislative Reference Bureau
Under current law, a public utility that owns, operates, manages or controls a
facility for the production, transmission or distribution of gas is required to
construct, operate and maintain the facility in a reasonably adequate and safe
manner. Current law also provides for a public complaint process regarding unsafe
facilities and authorizes the public service commission to investigate the facilities
and, after notice and a hearing, to issue orders or promulgate rules regarding the safe
construction and operation of these facilities. This bill amends these provisions to
apply to all facilities for the production, transmission or distribution of gas,
regardless of whether they are operated, managed or controlled by a public utility.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB966, s. 1 3Section 1. 196.745 (1) of the statutes is amended to read:
AB966,2,7 4196.745 (1) Each public utility which A person who owns, operates, manages
5or controls any facility for the production, transmission or distribution of gas shall
6construct, operate and maintain the facility in a reasonably adequate and safe
7manner. The commission may issue orders or rules, after holding a hearing,

1requiring the construction and operation of the facility to be safe, and may revise the
2orders or rules as required to promote public safety. Upon complaint to the
3commission that a facility of a public utility is unsafe, the commission may proceed
4under s. 196.26 or 196.28 (1). Those sections, as they apply to a public utility, apply
5to a person under this subsection.
After holding a hearing the commission shall order
6any alteration in construction, maintenance or operation required in the interest of
7public safety.
