AJR39,1,3 2Relating to: memorializing Congress to amend the internal revenue code to allow
3intrafamily transfers of property under the first-time farmer bond program.
AJR39,1,64 Whereas, the federal government allows first-time farmers to use proceeds of
5federally tax-exempt industrial revenue bonds to purchase their first farming
6operations; and
AJR39,1,97 Whereas, the state of Wisconsin in 1994 enacted legislation authorizing the
8Wisconsin Housing and Economic Development Authority to issue bonds for that
9purpose; and
AJR39,1,1110 Whereas, the U.S. internal revenue code does not allow proceeds of those bonds
11to be used to finance the transfer of property between family members; and
AJR39,1,1412 Whereas, the sale of land, buildings and equipment from one family member
13to another is a cornerstone of the family farming tradition in Wisconsin and in the
14nation; and

1Whereas, the internal revenue code provision arbitrarily and without purpose
2discourages the preservation of the family farm; and
AJR39,2,53 Whereas, it is in the economic and social interests of the state of Wisconsin that
4the internal revenue code be amended to preserve family farming for this and future
5generations; now, therefore, be it
AJR39,2,9 6Resolved by the assembly, the senate concurring, That the legislature of
7the state of Wisconsin urges the President and Congress to amend the internal
8revenue code to allow intrafamily transfers of property under first-time farmer bond
9program; and, be it further
AJR39,2,13 10Resolved, That the assembly chief clerk shall provide a copy of this joint
11resolution to the President of the United States, to each member of the Wisconsin
12congressional delegation and to each member of the U.S. Senate and House
13agriculture committees.
