SB102,1,2 1An Act to amend 120.13 (17) of the statutes; relating to: charging a fee for the
2temporary use of school property.

Under current law, a school board may grant the temporary use of school
grounds or facilities to any responsible person for any lawful nonschool purpose.
Current law allows the school board to charge a fee, not to exceed actual costs, for
such use, except that the school board must charge a reasonable fee for such use by
a religious organization. This bill eliminates the requirement that the school board
charge a religious organization.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB102, s. 1 3Section 1. 120.13 (17) of the statutes is amended to read:
SB102,2,44 120.13 (17) Temporary use of school property. Grant the temporary use of
5school grounds, buildings, facilities or equipment, upon such conditions, including
6fees not to exceed actual costs, as determined by the school board, to any responsible
7person for any lawful nonschool purpose if such use does not interfere with use for
8school purposes or school-related functions. The school board shall charge a
9reasonable fee for such use by religious organizations.
Fees received under this
10subsection shall be paid into the school district treasury and accounted for as

1prescribed under s. 115.28 (13). The user shall be primarily liable, and the school
2board secondarily liable, for any damage to property and for any expense incurred
3in consequence of any use of school grounds, buildings, facilities or equipment under
4this subsection.
