SB134,1,3 1An Act to repeal 29.405 (1) (a) and 29.405 (2) (a); to consolidate, renumber
2and amend
29.405 (1) (intro.) and (b) and 29.405 (2) (intro.) and (b); and to
3amend
29.405 (3) of the statutes; relating to: group deer hunting.
Analysis by the Legislative Reference Bureau
Under current law, a person hunting deer must immediately attach to the deer
that the hunter kills the tag issued to the hunter with his or her approval to hunt.
This requirement does not apply if the deer is killed by a member of a group deer
hunting party. Under current law, a member of such a group may kill a deer and use
the tag of another group member if the 2 members are within visual or voice contact
of each other. In this instance, the hunter killing the deer must make sure that the
other member attaches his or her tag to the killed deer without delay.
This bill eliminates the requirement that the 2 members of the group hunting
party be in visual or voice contact of each other. The bill also changes the timing
requirement for the tagging of the deer to require that the deer be tagged within
one-half hour after the deer is killed. The bill prohibits the member of the hunting
party who kills the deer from using a telephone, cellular telephone or other electronic
means to inform the other members of the kill. The bill also eliminates the
requirement under current law that the hunter who kills the deer stay with the deer
until it is tagged.
For further information see the state and local fiscal estimate, which will be
printed as an appendix to this bill.
