SB145,1,2 1An Act to create 943.014 of the statutes; relating to: demolition of historic
2buildings and providing a penalty.

Current law provides various penalties for intentionally causing property
damage without the owner's consent. This bill prohibits the intentional demolition
of a historic building without authorization from the applicable local governmental
body or officer. Upon conviction, violators must be fined not more than an amount
equal to 2 times the fair market value of the building and may be imprisoned for not
more than 9 months.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB145, s. 1 3Section 1. 943.014 of the statutes is created to read:
SB145,1,9 4943.014 Demolition of historic building without authorization. (1) In
5this section, "historic building" means any building or structure that is listed on, or
6any building or structure within and contributing to a historic district that is listed
7on, the national register of historic places in Wisconsin or the state register of historic
8places or any building or structure that is included on a list of historic places
9designated by a city, village, town or county.
SB145,2,2 10(2) Whoever intentionally demolishes a historic building without a permit
11issued by a city, village, town or county or without an order issued under s. 66.05 shall

1be fined an amount equal to 2 times the fair market value of the historic building
2immediately prior to demolition and may be imprisoned for not more than 9 months.
