SB214,1,2 1An Act to create 134.62 of the statutes; relating to: the sale and lease of paging
2devices.

This bill requires a person who manufacturers paging devices to affix to each
paging device a unique identification number. The bill also requires that a person
engaged in the retail sale or lease of a paging device in this state or to a person in this
state maintain a permanent record of the identification number of the paging device,
cross-referenced with the name and address of the person buying or leasing the
paging device, and file a copy of the record with the department of agriculture, trade
and consumer protection (DATCP). In addition, the bill provides that a law
enforcement officer may have access to the records filed with DATCP. The bill also
prohibits any person from removing, altering, obliterating or making it impossible
to read an identification number on a paging device.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB214, s. 1 3Section 1. 134.62 of the statutes is created to read:
SB214,1,4 4134.62 Sale and lease of paging devices. (1) In this section:
SB214,1,55 (a) "Law enforcement officer" has the meaning given in s. 165.85 (2) (c).
SB214,1,76 (b) "Paging device" means any portable electronic device used to contact a
7person carrying it when the device receives a radio or other signal.

1(2) A person manufacturing a paging device for sale or lease in this state or to
2a person in this state shall affix to each paging device a unique identification number.
SB214,2,4 3(3) A person offering for retail sale or lease a paging device in this state or to
4a person in this state shall:
SB214,2,75 (a) Maintain a permanent record of the identification number affixed to the
6paging device by the manufacturer under sub. (2), cross-referenced with the name
7and address of the person buying or leasing the paging device.
SB214,2,108 (b) File, within 30 days after the date of the sale or lease of a paging device, a
9copy of the record under par. (a) with the department of agriculture, trade and
10consumer protection.
SB214,2,13 11(4) The department of agriculture, trade and consumer protection shall make
12available to any law enforcement officer acting in an official capacity the records filed
13with the department under sub. (3) (b).
SB214,2,15 14(5) No person may remove, alter, obliterate or intentionally make it impossible
15to read an identification number affixed to a paging device.
SB214, s. 2 16Section 2. Effective date.
SB214,2,18 17(1) This act takes effect on the first day of the 6th month beginning after
18publication.
