SB250,1,2 An Act to amend 159.31 (1) (b) and 159.31 (3) (d); and to create 159.31 (1) (am) of the statutes; relating to: the recycled content of newspapers.

Analysis by the Legislative Reference Bureau

Under current law, the publisher of a newspaper is ordinarily required to pay a newspaper recycling fee unless the paper used by the publisher to print the newspaper contains at least a specified proportion of fiber derived from postconsumer waste.

Under this bill, fiber derived from waste paper resulting from printing is counted, up to a maximum of 10% of total fiber content, in determining whether the paper used by a newspaper publisher contains at least the specified recycled content.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB250, s. 1 Section 1. 159.31 (1) (am) of the statutes is created to read:

SB250,1,7 159.31 (1) (am) "Printer waste paper" means waste paper resulting from printing, including trimmings, overruns, copies that do not meet specifications and surplus copies of publications that are not sold at retail or delivered to their intended end users.

SB250, s. 2 Section 2. 159.31 (1) (b) of the statutes is amended to read:

SB250,2,3 159.31 (1) (b) "Recycled content" means the proportion of fiber in a newspaper that is derived from postconsumer waste and, subject to sub. (3) (d), printer waste paper.

SB250, s. 3 Section 3. 159.31 (3) (d) of the statutes is amended to read:

SB250,2,8 159.31 (3) (d) The actual recycled content is the average of the recycled content of all newsprint used by that publisher to print the publisher's newspaper during the year, except that the amount of fiber from printer waste paper included in the determination of actual recycled content may not exceed 10% of total fiber.
