SB391,1,2 1An Act to renumber and amend 991.11; and to create 991.11 (2) of the
2statutes; relating to: the effective date of acts affecting crimes.
Analysis by the Legislative Reference Bureau
Current law provides a default effective date for legislative acts. If an act has
no provision stating when it takes effect, it automatically takes effect on the day after
the act is published. This bill provides a delayed default effective date for certain acts
relating to crimes. Under the bill, if an act creates or affects any statute in the
criminal code or the criminal procedure code and the act does not contain language
stating when it takes effect, the act takes effect on the first day of the 2nd month after
it is published.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB391, s. 1 3Section 1. 991.11 of the statutes is renumbered 991.11 (1) and amended to

7expressly prescribe the time when it takes effect shall take effect on the day after its
8date of publication as designated under s. 35.095 (3) (b).
SB391, s. 2 9Section 2. 991.11 (2) of the statutes is created to read:

1991.11 (2) Every act and every portion of an act enacted by the legislature over
2the governor's partial veto that does not expressly prescribe the time when it takes
3effect and that creates or affects any statute in chs. 939 to 951 or 967 to 979 shall take
4effect on the first day of the 2nd month beginning after its date of publication as
5designated under s. 35.095 (3) (b).
