SB63,1,3 1An Act to amend 159.40 (3); and to create 159.42 (5) and 159.42 (6) of the
2statutes; relating to: materials eligible for assistance from the recycling
3market development board.
Analysis by the Legislative Reference Bureau
Under current law, the recycling market development board provides financial
and other assistance to improve the marketing of, and to develop markets for, certain
materials recovered from solid waste. Under current law, the board provides
assistance for materials that are recovered by recycling programs operated by local
governmental units and that are required to be recycled under this state's recycling
law.
This bill requires the recycling market development board to annually
establish a list of materials recovered from solid waste that are eligible for assistance
from the board. The list must include the materials that are required to be recycled
under this state's recycling law.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB63, s. 1 4Section 1. 159.40 (3) of the statutes is amended to read:
SB63,1,75 159.40 (3) "Recovered material" means a material specified in s. 159.07 (3) by
6the board under s. 159.42 (5)
that is recovered from solid waste in a recycling program
7established under subch. II
for recycling.
SB63, s. 2 8Section 2. 159.42 (5) of the statutes is created to read:

1159.42 (5) In consultation with the council on recycling, annually establish a
2list of materials recovered from solid waste for which financial assistance may be
3provided under this subchapter, which shall include the materials specified in s.
4159.07 (3), based on the board's analysis of current and future markets for materials
5recovered from solid waste.
SB63, s. 3 6Section 3. 159.42 (6) of the statutes is created to read:
SB63,2,87 159.42 (6) Biennially, submit a report to the legislature under s. 13.172 (2) on
8recycling market development priorities.
SB63, s. 4 9Section 4. Effective date.
SB63,2,10 10(1) This act takes effect on the 30th day following the date of publication.
