SB669,1,2 1An Act to renumber and amend 948.10; and to create 948.10 (1) of the stat
2utes; relating to: exposing genitals or pubic area and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law a person who, for sexually related reasons, either exposes
himself or herself to a child or causes the child to expose himself or herself is guilty
of a crime. Upon conviction, the person may be fined not more than $10,000 or im
prisoned for not more than 9 months or both. This bill raises the maximum period
of imprisonment to 2 years if the child is under 13 years old.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB669, s. 1 3Section 1. 948.10 of the statutes is renumbered 948.10 (2) and amended to
4read:
SB669,1,85 948.10 (2) Whoever, for purposes of sexual arousal or sexual gratification,
6causes a child who has attained 13 years of age to expose genitals or pubic area or
7exposes genitals or pubic area to a child who has attained 13 years of age is guilty
8of a Class A misdemeanor.
SB669,1,9 9(3) This section does not apply if the child is the defendant's spouse.
SB669, s. 2 10Section 2. 948.10 (1) of the statutes is created to read:

1948.10 (1) Whoever, for purposes of sexual arousal or sexual gratification,
2causes a child who has not attained the age of 13 years to expose genitals or pubic
3area or exposes genitals or pubic area to a child who has not attained the age of 13
4years is guilty of a Class E felony.
