SJR19,1,2 1To create section 25 of article I of the constitution; relating to: the right of parents
2to direct the upbringing and education of their children (first consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 1995 legislature on first
consideration, creates a new section of article I of the state constitution. Article I
contains the state constitution's declaration of rights. The new section of article I
created by this constitutional amendment declares that:
"Section 25 (1) The right of parents to direct the upbringing and education of
their children may not be infringed.
(2) The legislature may enforce this section by appropriate legislation."
As a constitutional amendment, the proposal requires adoption by 2 successive
legislatures, and ratification by the people, before it can become effective.
SJR19,1,3 3Resolved by the senate, the assembly concurring, That:
SJR19, s. 1 4Section 1. Section 25 of article I of the constitution is created to read:
SJR19,1,65 [Article I] Section 25 (1) The right of parents to direct the upbringing and
6education of their children may not be infringed.
SJR19,1,77 (2) The legislature may enforce this section by appropriate legislation.
SJR19, s. 2 8Section 2. Numbering of new section. The new section "25" of article I of the
9constitution, created in this joint resolution, shall be designated by the next higher
10open whole section number in that article if, prior to or simultaneously with the
11ratification by the people of the amendment proposed in this joint resolution, any

1other ratified amendment has created a "section 25" of article I of the constitution
2of this state. If several joint resolutions simultaneously create a section 25 of article
3I, the chief of the legislative reference bureau shall determine the sequence and the
4numbering.
SJR19,2,7 5Be it further resolved, That this proposed amendment be referred to the
6legislature to be chosen at the next general election and that it be published for 3
7months previous to the time of holding such election.
