Current law authorizes the department of natural resources (DNR) to
promulgate rules for obtaining pure drinking water for human consumption and to
supervise and control the construction of wells. Current DNR rules relating to well
construction include requirements that apply to pitless adapters. A pitless adapter
is a device that attaches a well casing pipe to an underground pipe that carries water
from the well to the building served by the well. DNR promulgated a rule prohibiting
a pitless adapter from extending into the inside of a well casing pipe so that setting
or removal of the pump or pump piping is impeded.
This bill prohibits a person from installing any pitless adapter that extends into
the inside of a well casing pipe.
This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
action of the joint committee for review of administrative rules in suspending a
portion of section NR 812.30 (2) (b), Wis. Adm. Code, a DNR rule, on September 18,
1996. The suspended portion of the rule allowed a pitless adapter to extend into a
well casing pipe if the pitless adapter did not impede the setting or removal of the
pump or pump piping.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
