AB213,1,2 1An Act to amend 12.05 of the statutes; relating to: false representations by
2candidates concerning reelection to office.
Analysis by the Legislative Reference Bureau
Currently, no person may knowingly make or publish, or cause to be made or
published, a false representation pertaining to a candidate or referendum which is
intended or tends to affect voting at an election. Violators are subject to a fine of not
more than $1,000 or imprisonment for not more than 6 months or both.
This bill provides that a violation of this law includes a representation that a
person is a candidate for reelection to an office if the person is not an incumbent in
that office and has not been elected to that office.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB213, s. 1 3Section 1. 12.05 of the statutes is amended to read:
AB213,2,2 412.05 False representations affecting elections. No person may
5knowingly make or publish, or cause to be made or published, a false representation
6pertaining to a candidate or referendum which is intended or tends to affect voting
7at an election. A violation of this section includes a representation that a person is

1a candidate for reelection to an office if the person is not an incumbent in that office
2and has not been elected to that office.
