AB229,1,3 1An Act to create 36.38, 38.12 (12), 39.49, 118.39 and 175.22 of the statutes;
2relating to: written policies on entering locker rooms being used by athletic
3teams representing certain schools or by professional athletic teams.

This bill requires each school board, private school, technical college district
board, institution and center within the University of Wisconsin System, private
institution of higher education, and professional athletic team that has its home field
or arena in this state, to adopt a written policy on who may enter and remain in a
locker room used by the school or team for the purpose of interviewing or seeking
information from any person. The policy must reflect the privacy interests of the
members of the teams representing the school or the professional athletic team.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB229, s. 1 4Section 1. 36.38 of the statutes is created to read:
AB229,2,4 536.38 Policy on privacy in athletic locker rooms. Each institution and
6center within the system shall adopt a written policy on who may enter and remain,

1for the purpose of interviewing or seeking information from any person, in a locker
2room being used by an athletic team representing the institution or center. The
3policy shall reflect the privacy interests of members of athletic teams representing
4the institution or center.
AB229, s. 2 5Section 2. 38.12 (12) of the statutes is created to read:
AB229,2,106 38.12 (12) Policy on privacy in athletic locker rooms. The district board shall
7adopt a written policy on who may enter and remain, for the purpose of interviewing
8or seeking information from any person, in a locker room being used by an athletic
9team representing the district. The policy shall reflect the privacy interests of
10members of athletic teams representing the district.
AB229, s. 3 11Section 3. 39.49 of the statutes is created to read:
AB229,2,16 1239.49 Policy on privacy in athletic locker rooms. (1) In this section,
13"institution of higher education" means a private educational institution that
14awards a bachelor's or higher degree or provides a program that is acceptable for
15credit toward such a degree, and that fields an athletic team that represents the
16institution.
AB229,2,21 17(2) Each institution of higher education shall adopt a written policy on who
18may enter and remain, for the purpose of interviewing or seeking information from
19any person, in a locker room being used by an athletic team representing the
20institution. The policy shall reflect the privacy interests of members of athletic
21teams representing the institution.
AB229, s. 4 22Section 4. 118.39 of the statutes is created to read:
AB229,3,4 23118.39 Policy on privacy in athletic locker rooms. Each school board, and
24the governing body of each private school that fields an athletic team representing
25the school, shall adopt a written policy on who may enter and remain, for the purpose

1of interviewing or seeking information from any person, in a locker room being used
2by an athletic team representing the private school or representing a public school
3in the school district. The policy shall reflect the privacy interests of members of
4athletic teams representing the school.
AB229, s. 5 5Section 5. 175.22 of the statutes is created to read:
AB229,3,11 6175.22 Policy on privacy for professional athletic teams. Any
7professional athletic team that has its home field or arena in this state shall adopt
8a written policy on who may enter and remain, for the purpose of interviewing or
9seeking information from any person, in a locker room used by the professional
10athletic team. The policy shall reflect the privacy interests of members of the
11professional athletic team.
AB229, s. 6 12Section 6. Effective date.
AB229,3,1413 (1) This act takes effect on the first day of the 6th month beginning after
14publication.
