AB336,1,3 1An Act to amend 134.65 (2) (a) and 134.65 (2) (b) of the statutes; relating to:
2fees for retailer licenses for selling and giving away cigarettes and tobacco
3products.
Analysis by the Legislative Reference Bureau
Under current law, no person may sell or give away any cigarettes or tobacco
products without holding a cigarettes and tobacco products retailer license issued by
a city, village or town. Currently, the annual fee for this license is $5. The bill
requires the city, village or town to set the fee at not less than $5 nor more than $25.

printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB336, s. 1 4Section 1. 134.65 (2) (a) of the statutes is amended to read:
AB336,2,25 134.65 (2) (a) Except as provided in par. (b), upon filing of a proper written
6application a license shall be issued on July 1 of each year or when applied for and
7continue in force until the following June 30 unless sooner revoked. The fee for the

1license is $5 which shall be paid to the city, village or town treasurer before the license
2is issued.
AB336, s. 2 3Section 2. 134.65 (2) (b) of the statutes is amended to read:
AB336,2,84 134.65 (2) (b) In any municipality electing to come under this paragraph, upon
5filing of a proper written application a license shall be issued and continue in force
6for one year from the date of issuance unless sooner revoked. The fee for the license
7is $5 which shall be paid to the city, village or town treasurer before the license is
8issued.
AB336, s. 3 9Section 3. 134.65 (2) (c) of the statutes is created to read:
AB336,2,1110 134.65 (2) (c) The city, village or town shall establish the fee under par. (a) or
11(b) in an amount that is not less than $5 nor more than $25.
