AB40,1,2 1An Act to amend 61.23 (1) and 62.09 (5) (d) of the statutes; relating to: the
2appointment of a person to act as a village trustee or common council member.

Under current law, if any city or village officer is absent or temporarily
incapacitated from any cause the common council or village board may appoint some
person to discharge the officer's duties until the officer returns or until the disability
is removed. Under the bill, this current law provision is limited to apply only to
officers other than alderpersons and village trustees. Also under the bill, if an
alderperson or trustee is temporarily incapacitated because of physical or mental
disability, the board may appoint a person to discharge the alderperson's or trustee's
duties until the disability is removed.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB40, s. 1 3Section 1. 61.23 (1) of the statutes is amended to read:
AB40,2,64 61.23 (1) Except as otherwise provided by law, the term of office of all village
5officers is 2 years. Persons serving in appointive offices shall serve until their

1respective successors are appointed and qualify. If any officer other than a trustee
2is absent or temporarily incapacitated from any cause the board may appoint some
3person to discharge the officer's duties until the officer returns or until such
4disability is removed. If a trustee is temporarily incapacitated because of physical
5or mental disability, the board may appoint a person to discharge the trustee's duties
6until the disability is removed.
AB40, s. 2 7Section 2. 62.09 (5) (d) of the statutes is amended to read:
AB40,2,138 62.09 (5) (d) If any officer be other than an alderperson is incapacitated or
9absent from any cause the common council may appoint some person to discharge the
10officer's duties until the officer returns or until such disability is removed. If an
11alderperson is temporarily incapacitated because of physical or mental disability, the
12common council may appoint a person to discharge the alderperson's duties until the
13disability is removed.
