AB420,1,2 1An Act to amend 19.35 (3) (c) of the statutes; relating to: assessment of fees for

Currently, unless otherwise provided by law or authorized to be prescribed by
law, if a requester has the right to inspect or copy public records, and the cost of
locating the records is $50 or more, the custodian of the records may charge the
requester for the actual, necessary and direct cost of locating the records.
This bill provides that, unless otherwise provided by law or authorized to be
prescribed by law, a custodian may charge a requester for the actual, necessary and
direct cost of locating public records if the cost is $5 or more.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB420, s. 1 3Section 1. 19.35 (3) (c) of the statutes is amended to read:
AB420,2,24 19.35 (3) (c) Except as otherwise provided by law or as authorized to be
5prescribed by law, an authority may impose a fee upon a requester for locating a

1record, not exceeding the actual, necessary and direct cost of location, if the cost is
2$50 $5 or more.
