AB465,1,3 1An Act to renumber and amend 213.11 (2); to amend 213.11 (1), 213.11 (3) and
2213.11 (5); and to create 213.11 (2) (b) and (c) of the statutes; relating to:
3various changes in the provisions regarding police relief associations.
Analysis by the Legislative Reference Bureau
Under current law, the purpose of a police relief association, which consists of
the members of the police department of a city, is to provide relief to the sick and
disabled members of the association and their families. If a member at death leaves
no one entitled to relief under the constitution and bylaws of the association, the
board of trustees of the association may pay the expenses of the last illness and
funeral costs of the deceased member. A person who is a member of a police relief
association and who is no longer in the active employment of the police department
due to retirement on a pension or annuity may still receive the benefits provided by
the association as long as the person served in the police department for at least 5
years. Also under current law, the members of the board of trustees of a police relief
association are to be elected annually, and only those association members who are
in the active employment of the police department may be elected to the board of
trustees.
This bill changes the purpose of a police relief association to that of providing
death benefits to the beneficiaries of members of the association. The bill also
provides that members no longer in the active employment of the police department
who may continue to receive the benefits of the association after at least 5 years'
service in the department include, in addition to those who are retired, those who are

on a leave of absence for a purpose that is specified in the bylaws of the association
and those who are serving as a liaison between the police department and the city
in which the police department is located. The bill provides that the members of the
board of trustees of the association are to be elected for terms that are specified in
the bylaws of the association, rather than annually. In addition, members of the
association who are no longer in the active employment of the police department
because they are serving as liaisons between the police department and the city may
be elected to the board of trustees.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB465, s. 1 1Section 1. 213.11 (1) of the statutes is amended to read:
AB465,2,132 213.11 (1) The members of the paid police department in any city heretofore
3or hereafter organized, who comply with the constitution and bylaws of the
4association hereinafter mentioned, are constituted a body corporate in such city
5under the name of "The Policemen Police Relief Association of the City of ....," for the
6purpose of giving relief to the sick and disabled providing death benefits to the
7beneficiaries of the
members of such association and their families and to such other
8persons as the constitution and bylaws of such association may provide . Provided,
9that where a member in good standing at the time of the member's death leaves no
10one entitled to relief under the constitution and bylaws of said association, such
11board is empowered to pay the expenses of the last illness and funeral costs of said
12deceased member
, the amount to be paid hereunder in benefits to be limited to a sum
13to be fixed by the constitution and bylaws of said association.
AB465, s. 2 14Section 2. 213.11 (2) of the statutes is renumbered 213.11 (2) (intro.) and
15amended to read:

17association shall cease who, after at least 5 years of service, ceases to act with the
18police department of which that person has been a member, after five years of service,

shall continue to enjoy all the advantages and benefits of the association
2as long as the person complies with the rules, regulations and bylaws of the same and
3pays dues, unless the connection of such person with said department was
4discontinued for the good of the service; provided, that all persons becoming
5members of such policemen relief association on and after the first day of May, 1899,
6shall not be entitled to any of the advantages and benefits of such association from
7and after the time when they cease to be active members of such police department
8of any city aforesaid, unless such member
, and provided that the person ceases to be
9active in the active employment of the police department by reason of having been
10any of the following:
AB465,3,11 11(a) The person is retired from active service on a pension or annuity.
AB465, s. 3 12Section 3. 213.11 (2) (b) and (c) of the statutes are created to read:
AB465,3,1413 213.11 (2) (b) The person is on a leave of absence for a purpose that is specified
14in the bylaws of the association.
AB465,3,1615 (c) The person is serving as a liaison between the police department and the
16city in which the department is located.
AB465, s. 4 17Section 4. 213.11 (3) of the statutes is amended to read:
AB465,3,2218 213.11 (3) Each A person becoming who becomes a member of such police
19department after this section comes into force and effect in any city in this state shall,
20within one year after becoming a member of such department, be required to join
21such association and to pay an initiation fee not exceeding fifty dollars $50 and
22annual dues so long as the person remains a member.
AB465, s. 5 23Section 5. 213.11 (5) of the statutes is amended to read:
AB465,4,2024 213.11 (5) The control and disposal of the funds, property and estate and the
25direction and management of all the concerns of such corporation, under such

1direction and restrictions as may be imposed by the bylaws thereof, shall be vested
2in a board of trustees to consist of a president, vice president, treasurer, secretary and
3executive committee of three 3, who shall be elected annually for such terms, at such
4time and place and by such members of the corporation as shall by the bylaws thereof
5be entitled to vote at such election
of the corporation may provide; and such officers
6so elected shall hold their respective offices for one year and until their successors
7are elected and qualified; and such corporation may elect or appoint such other
8officers and for such terms as its bylaws may prescribe. The officers of such
9corporation shall give bonds for the faithful performance of their respective duties
10when required so to do by the laws thereof. No person shall may be elected to or hold
11any office in such corporation unless that person be is employed by the city to which
12this section becomes effective and
in the active employment of the police department
13of the city to which this section becomes effective, and if or no longer in the active
14employment of the police department because the person is serving as a liaison
15between the police department and the city. If
that person's employment with such
16city shall be is terminated while holding the office of trustee or any other office of such
17corporation, that person's term of office shall thereupon be terminated, and the
18members of such corporation as shall are, by the bylaws thereof, be entitled to vote,
19shall forthwith elect that person's successor in the manner prescribed by the
20constitution and bylaws of the corporation
.
