AB593,1,3 1An Act to create 146.49 of the statutes; relating to: prohibiting the use of
2certain latex products by health care providers and granting rule-making
3authority.

Beginning November 1, 1998, this bill prohibits certain health care providers
from using a latex product that is coated with a preparation of fine particles of talc
or other mineral or cornstarch. (The health care providers are licensed nurses,
chiropractors, dentists, physicians, podiatrists, physical therapists, optometrists
and pharmacists and certified occupational therapists, occupational therapy
assistants, physician assistants, respiratory care practitioners, dietitians and
acupuncturists.) The bill also prohibits the health care providers from using a latex
product that contains protein if the amount of protein exceeds the permitted
maximum levels of protein in latex products that are established by rule by the
department of health and family services (DHFS). DHFS is required, under the bill,
to promulgate rules that establish these maximum levels for latex products that are
used by health care providers.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB593, s. 1 4Section 1. 146.49 of the statutes is created to read:
AB593,1,6 5146.49 Use of latex products by health care providers. (1) In this section,
6"health care provider" has the meaning given in s. 146.81 (1) (intro.) and (a) to (g).

1(2) No health care provider may use a latex product that is coated with a
2preparation of fine particles of talc or other mineral or cornstarch.
AB593,2,5 3(3) No health care provider may use a latex product that contains protein
4unless the amount of protein in the latex product does not exceed the maximum
5levels of protein, as established by rule, that may be contained in latex products.
AB593,2,7 6(4) The department shall promulgate rules that establish maximum levels of
7protein that may be contained in latex products used by health care providers.
AB593, s. 2 8Section 2. Nonstatutory provisions.
AB593,2,129 (1) The department of health and family services shall submit in proposed form
10the rules required under section 146.49 (4) of the statutes, as created by this act, to
11the legislative council staff under section 227.15 (1) of the statutes no later than the
12first day of the 7th month beginning after the effective date of this subsection.
