Current law prohibits inattentive driving. The driver of a motor vehicle is
prohibited from being so engaged or occupied as to interfere with the safe driving of
the vehicle. Violators may be required to forfeit not less than $20 nor more than $400.
This bill prohibits the driver of a motor vehicle from being so engaged or
occupied with the use of a mobile telecommunications device as to interfere with the
safe driving of the vehicle or as to impede the flow of traffic. The bill does not define
"mobile telecommunications device".
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB680, s. 1 4Section 1. 346.89 (1m) of the statutes is created to read:
AB680,2,25 346.89 (1m) No person while driving a motor vehicle shall be so engaged or
6occupied with the use of a mobile telecommunications device as to interfere with the

1safe driving of such vehicle or as to impede the normal and reasonable movement of
2traffic.
AB680, s. 2 3Section 2. 346.95 (2g) of the statutes is created to read:
AB680,2,54 346.95 (2g) Any person violating s. 346.89 (1m) may be required to forfeit not
5less than $50 nor more than $400.
