AB732,1,3 1An Act to amend 29.40 (2m) (a), 29.40 (2m) (b), 29.48 (1) (a) 1., 29.578 (8) and
229.578 (14) (b) 3.; and to create 29.40 (2m) (c) and 29.48 (1r) of the statutes;
3relating to: the distribution of meat from deer carcasses.
Analysis by the Legislative Reference Bureau
Under current law, no person, except the department of natural resources in
certain circumstances, may sell deer carcasses or meat. This bill creates an exception
to this general prohibition for persons who receive deer carcasses for processing from
persons who fail to pick up the deer meat once it is processed. Under the bill, these
processors may sell the deer meat at a price that equals the cost of processing the
meat.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB732, s. 1 4Section 1. 29.40 (2m) (a) of the statutes is amended to read:
AB732,2,25 29.40 (2m) (a) A deer carcass tag attached under sub. (2) and a registration tag
6attached by the department or a car kill tag attached under sub. (5) may be removed
7from a gutted carcass at the time of butchering, but the person who killed or obtained

1possesses the deer carcass or meat shall retain ensure that all tags remain with the
2carcass or meat
until the meat is consumed.
AB732, s. 2 3Section 2. 29.40 (2m) (b) of the statutes is amended to read:
AB732,2,64 29.40 (2m) (b) Any person who retains a tag under par. (a) possesses a deer
5carcass or meat from a deer the person has killed
may give the deer carcass or meat
6to another person. The
AB732,2,8 7(d) A person who receives the gift of deer carcass or meat under par. (b) or (c)
8is not required to possess a tag.
AB732, s. 3 9Section 3. 29.40 (2m) (c) of the statutes is created to read:
AB732,2,1210 29.40 (2m) (c) A person who is butchering or processing a deer carcass for
11another person who left the carcass for butchering or processing may give the deer
12meat to another person if the person who left the carcass fails to claim the deer meat.
AB732, s. 4 13Section 4. 29.48 (1) (a) 1. of the statutes is amended to read:
AB732,2,1514 29.48 (1) (a) 1. Deer, bear, squirrel, game bird, game fish or the carcass thereof
15at any time except as provided in sub. (1r).
AB732, s. 5 16Section 5. 29.48 (1r) of the statutes is created to read:
AB732,2,2017 29.48 (1r) A person who is butchering or processing a deer carcass for another
18person who left the carcass for butchering or processing may sell the deer meat to
19another person for an amount that is equal to cost of butchering or processing if the
20person who left the carcass fails to claim the deer meat.
AB732, s. 6 21Section 6. 29.578 (8) of the statutes is amended to read:
AB732,3,222 29.578 (8) After a deer is so killed and tagged the entire carcass only shall be
23sold and transported, except as provided in sub. (14). The tag must remain on the
24carcass while in transit. A deer farm tag may be removed from a gutted carcass at
25the time of butchering, but the person who killed or obtained possesses the deer

1carcass or meat shall retain ensure that the tag remains with the carcass or meat
2until the meat is consumed.
AB732, s. 7 3Section 7. 29.578 (14) (b) 3. of the statutes is amended to read:
AB732,3,104 29.578 (14) (b) 3. It shall contain the name and address of the applicant
5together with the name and address of the premises where the venison will be
6retained and served, together with the source of the venison, the sex, approximate
7weight and deer farm tag numbers of the carcass. The deer farm tag may be removed
8from a gutted carcass at the time of butchering, but the person who killed or obtained
9possesses the deer carcass or meat shall retain ensure that the tag remains with the
10carcass or meat
until the venison is consumed.
