1An Act to create 16.72 (9) and 93.07 (26) of the statutes;
relating to: purchase
2of dairy cheese for state institutions and granting rule-making authority.

Currently, the department of administration makes purchases for state
institutions but may delegate this responsibility to a state agency that operates an
institution. There are no requirements or limitations concerning the procurement
of cheese for the institutions.
This bill requires that, effective on January 1, 1999, whenever cheese is
purchased for state institutions (the University of Wisconsin System campuses and
state prisons, centers, institutes and schools), the cheese must be dairy cheese. The
bill directs the department of agriculture, trade and consumer protection to define,
by rule, the term "dairy cheese".

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 16.72 (9) of the statutes is created to read:

(9) (a) In this subsection, "institution" has the meaning given in s. 36.05
5(9), and also includes every state prison and every center, institute and school
1operated by the department of health and family services or the department of public
2instruction.

(b) The department shall ensure that whenever cheese is purchased for the use
4of any state institution, the cheese is dairy cheese, as defined by the department of
5agriculture, trade and consumer protection under s. 93.07 (26).

(1) The treatment of section 16.72 (9) (b) of the statutes first applies with
11respect to orders placed and contracts entered into on January 1, 1999.

(1) The department of agriculture, trade and consumer protection shall submit
14proposed rules under section 93.07 (26) of the statutes, as created by this act, to the
15legislative council staff for review under section 227.15 (1) of the statutes no later
16than September 1, 1998.
