AB845,1,3 1An Act to repeal chapter 199, 227.485 (2) (e) and 814.245 (2) (d); and to amend
2196.20 (4) (a) 2. and 285.41 (1) (f) of the statutes; relating to: eliminating the
3citizens utility board.

This bill eliminates the citizens utility board.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB845, s. 1 4Section 1. 196.20 (4) (a) 2. of the statutes is amended to read:
AB845,2,25 196.20 (4) (a) 2. "Electric public utility" means a public utility whose purpose
6is the generation, transmission, delivery or furnishing of electric power but does not
7include a public utility owned and operated wholly by a municipality or cooperative
8and does not include any public utility which purchases, under federal or state
9approved wholesale rates, more than 50% of its electric power requirements from
10other than an affiliated interest as defined under s. 196.52. "Electric public utility"

1does not include any Class A utility, as defined under s. 199.03 (4), 1995 stats., whose
2electric generation equipment has a total capacity of less than 30 megawatts.
AB845, s. 2 3Section 2. Chapter 199 of the statutes is repealed.
AB845, s. 3 4Section 3. 227.485 (2) (e) of the statutes, as affected by 1997 Wisconsin Act 27,
5is repealed.
AB845, s. 4 6Section 4. 285.41 (1) (f) of the statutes is amended to read:
AB845,2,117 285.41 (1) (f) "Major utility" means a Class A utility, as defined under s. 199.03
8(4), 1995 stats., which generates electricity or an electrical cooperative association
9organized under ch. 185, if the total sulfur dioxide emissions from all stationary air
10contaminant sources in this state under the ownership or control of the utility or
11association exceeded 5,000 tons in any year after 1979.
AB845, s. 5 12Section 5. 814.245 (2) (d) of the statutes is repealed.
AB845, s. 6 13Section 6. Effective date.
AB845,2,1414 (1) This act takes effect on July 1, 1998.
