SB110,1,3 1An Act to repeal 15.05 (1) (d); and to amend 15.05 (1) (b) of the statutes;
2relating to: the appointment of the secretary of agriculture, trade and
3consumer protection.
Analysis by the Legislative Reference Bureau
Under current law, the secretary of agriculture, trade and consumer protection
is appointed by the governor, with the approval of the senate. Under this bill, the
secretary of agriculture, trade and consumer protection is appointed by the board of
agriculture, trade and consumer protection.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB110, s. 1 4Section 1. 15.05 (1) (b) of the statutes is amended to read:
SB110,2,55 15.05 (1) (b) Except as provided in pars. par. (c) and (d), if a department is under
6the direction and supervision of a board, the board shall appoint a secretary to serve
7at the pleasure of the board outside the classified service. In such departments, the
8powers and duties of the board shall be regulatory, advisory and policy-making, and

1not administrative. All of the administrative powers and duties of the department
2are vested in the secretary, to be administered by him or her under the direction of
3the board. The secretary, with the approval of the board, shall promulgate rules for
4administering the department and performing the duties assigned to the
5department.
