SB216,1,2 1An Act to amend 118.245 (3) of the statutes; relating to: school district
2professional employe compensation and fringe benefits.

Under current law, no school district may provide to its nonrepresented
professional employes, for any 12-month period ending on June 30, an average
increase for all such employes in the total cost to the school district of compensation
and fringe benefits for such employes that has an average cost per employe exceeding
3.8% of the average total cost per employe of compensation and fringe benefits
provided by the school district to its nonrepresented professional employes for the
preceding 12-month period ending on June 30 or the average total percentage
increased cost per employe of compensation and fringe benefits provided to its
represented professional employes during the 12-month period ending on June 30
preceding the date that the increase becomes effective, whichever is greater.
This bill provides that the increased cost of compensation and fringe benefits
for nonrepresented professional employes does not include any cost incurred due to
an increase in hours for a nonrepresented professional employe who is employed less
than full time on a weekly or annual basis but who subsequently becomes employed
at a level that is not greater than full time on a weekly or annual basis.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 118.245 (3) of the statutes is amended to read:

3employes for any 12-month period ending on June 30 an average increase for all such
4employes in the total cost to the school district of compensation and fringe benefits
5for such employes having an average cost per employe exceeding 3.8% of the average
6total cost per employe of compensation and fringe benefits provided by the school
7district to its nonrepresented professional employes for the preceding 12-month
8period ending on June 30 or the average total percentage increased cost per employe
9of compensation and fringe benefits provided to its represented professional
10employes during the 12-month period ending on June 30 preceding the date that the
11increase becomes effective, whichever is greater. In this subsection, the cost of
12compensation includes the cost of any increase in compensation due to a promotion
13or the attainment of increased professional qualifications. In this subsection, the
14increased cost of compensation and fringe benefits does not include any cost incurred
15due to an increase in hours for a nonrepresented professional employe who is
16employed less than full time on a weekly or annual basis but who subsequently
17becomes employed at a level that is not greater than full time on a weekly or annual
18basis.
For purposes of this subsection, the average total percentage increased cost
19per employe of the compensation provided by a school district to its represented
20professional employes shall be determined in accordance with the method prescribed
21by the employment relations commission under s. 111.70 (4) (cm) 8s.
