14campuses in the University of Wisconsin System.
Analysis by the Legislative Reference Bureau
This bill changes the name of the 2-year campuses in the University of
Wisconsin (UW) System from "centers" to "college campuses". The bill also
designates the college campuses as a whole as the University of Wisconsin Colleges

and identifies the University of Wisconsin Colleges as an institution within the UW
System.
Current law authorizes a school board, cooperative educational service agency,
technical college district board or UW institution or 2-year campus, either
individually or in any combination, to request the educational communications
board to assist in funding the development of a distance education project. This bill
eliminates the authority of an individual 2-year campus to make such a request.

an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB288, s. 1 1Section 1. 13.48 (2) (f) of the statutes is amended to read:
SB288,2,72 13.48 (2) (f) The building commission may allocate funds from the state
3building trust fund or other sources available to them to equip any university of
4Wisconsin system center college campus, as defined in s. 36.05 (6m), if the facilities
5have been provided by the counties or other units of local government under s. 66.51
6or 67.04 and the operation of the center college campus has been approved by the
7board of regents of the university of Wisconsin system.
SB288, s. 2 8Section 2. 15.105 (26) (a) 7. of the statutes is amended to read:
SB288,2,109 15.105 (26) (a) 7. An employe of a University of Wisconsin System institution
10or center.
SB288, s. 3 11Section 3. 15.91 of the statutes is amended to read:
SB288,3,7 1215.91 Board of regents of the university of Wisconsin system; creation.
13There is created a board of regents of the university of Wisconsin system consisting
14of the state superintendent of public instruction, the president, or by his or her
15designation another member, of the technical college system board and 14 citizen
16members appointed for staggered 7-year terms, and a student enrolled at least
17half-time and in good academic standing at an institution or center within the

1university of Wisconsin system who is at least 18 years old and a resident of this
2state, for a 2-year term. The student member may be selected from
3recommendations made by elected representatives of student governments at
4institutions and centers within the university of Wisconsin system. The governor
5may not appoint a student member from the same institution or center in any 2
6consecutive terms. If the student member loses the status upon which the
7appointment was based, he or she shall cease to be a member of the board of regents.
SB288, s. 4 8Section 4. 16.847 (1) (b) of the statutes is amended to read:
SB288,3,119 16.847 (1) (b) "State facilities" means all property owned and operated by the
10state for the purpose of carrying out usual state functions, including each center and
11institution within the university of Wisconsin system.
SB288, s. 5 12Section 5. 20.285 (1) (h) of the statutes is amended to read:
SB288,4,313 20.285 (1) (h) Auxiliary enterprises. Except as provided under par. (gm) and
14subs. (5) (i) and (6) (g), all moneys received by the university of Wisconsin system for
15or on account of any housing facility, commons, dining halls, cafeteria, student union,
16athletic activities, stationery stand or bookstore, parking facilities or car fleet, or
17such other auxiliary enterprise activities as the board designates and including such
18fee revenues as allocated by the board and including such moneys received under
19leases entered into previously with nonprofit building corporations as the board
20designates to be receipts under this paragraph, to be used for the operation,
21maintenance and capital expenditures of activities specified in this paragraph,
22including the transfer of funds to pars. (kd) and (ke) and to nonprofit building
23corporations to be used by the corporations for the retirement of existing
24indebtedness and such other payments as may be required under existing loan
25agreements, and for optional rental payments in addition to the mandatory rental

1payments under the leases and subleases in connection with the providing of
2facilities for such activities. A separate account shall be maintained for each campus,
3the center system
and extension.
SB288, s. 6 4Section 6. 20.285 (1) (ha) of the statutes is amended to read:
SB288,4,145 20.285 (1) (ha) Stores. All moneys received for the operation of a university
6stores division at any campus, center system or extension, to be used for the
7operation of a university stores division at any campus, for the center system or for
8extension, and to permit sales from these stores divisions to other divisions of the
9university, any agency of the state, local government or federal government, or to
10university related activities, and to permit cooperation between the stores divisions
11and any board, commission or department of state, local or federal government and
12the university. A separate account shall be maintained for each stores division
13operated pursuant to this paragraph, and funds in these accounts shall not be
14commingled.
SB288, s. 7 15Section 7. 20.285 (2) (h) of the statutes is amended to read:
SB288,4,2416 20.285 (2) (h) (title) University of Wisconsin center college campus at Medford.
17Of the amounts appropriated to the board of regents of the university of Wisconsin
18system under sub. (1) (a), the board of regents may pay to the Taylor county board
19of supervisors, for outstanding debt service costs on the university of Wisconsin
20center college campus at Medford facilities, up to $24,500 annually until the facilities
21are sold or an alternative use for the facilities is found. Payments shall be made on
22a schedule and in the manner the board determines. If the facilities are sold or an
23alternative use for the facilities is found, the Taylor county board of supervisors shall
24repay to the state all amounts received under this paragraph.
SB288, s. 8 25Section 8. 20.923 (4m) of the statutes is amended to read:

120.923 (4m) University of Wisconsin system executive positions. The board
2of regents of the university of Wisconsin system shall set the salaries of the president
3of the university of Wisconsin system at a point no higher than 15% above the
4maximum dollar value of the salary range for executive salary group 10, based on the
5competitive market for comparable positions at comparable institutions of higher
6education. The board shall set the salaries of the vice presidents, the chancellors of
7the university of Wisconsin system campuses at Eau Claire, Green Bay, La Crosse,
8Oshkosh, Parkside, Platteville, River Falls, Stevens Point, Stout, Superior and
9Whitewater, the chancellors of the university of Wisconsin-center system Wisconsin
10Colleges
and the university of Wisconsin-extension, the vice chancellor for health
11sciences of the university of Wisconsin-Madison and the vice chancellor who is
12serving as a deputy at each university of Wisconsin campus and the university of
13Wisconsin-center system
institution and the university of Wisconsin-extension to
14reflect the hierarchical structure of the system, to recognize merit, to permit orderly
15salary progression and to recognize competitive factors. No salary for a position other
16than president may be set at a point lower than the minimum dollar value of the
17salary range for executive salary group 7 nor at a point equal to or higher than the
18maximum dollar value of the salary range for executive salary group 10.
SB288, s. 9 19Section 9. 20.923 (5) of the statutes is amended to read:
SB288,6,1020 20.923 (5) Other University of Wisconsin system administrative positions.
21The board of regents of the university of Wisconsin system shall assign the positions
22of associate and assistant vice presidents, vice chancellors not identified in sub. (4m),
23assistant chancellors, associate and assistant vice chancellors and administrative
24directors and associate directors of physical plant, general operations and services
25and auxiliary enterprises activities or their equivalent, of each university of

1Wisconsin system campus, the university of Wisconsin-center system institution,
2the university of Wisconsin-extension and the university of Wisconsin system
3administration to salary ranges. The salary for each such position is limited only by
4the maximum dollar value of the salary range to which the position is assigned. No
5position specified in this subsection may be assigned to a salary range having a
6maximum dollar value higher than the maximum dollar value of the salary range for
7executive salary group 6. The board of regents shall annually review the assignment
8of the positions specified in this subsection and report any changes therein to the
9governor and the chief clerk of each house of the legislature for distribution to the
10appropriate standing committees under s. 13.172 (3).
SB288, s. 10 11Section 10. 21.49 (1) (b) 1. of the statutes is amended to read:
SB288,6,1312 21.49 (1) (b) 1. The extension division and any center or campus of the
13university of Wisconsin system.
SB288, s. 11 14Section 11. 36.05 (3) of the statutes is amended to read:
SB288,6,1615 36.05 (3) "Campus" means the publicly owned or leased buildings and grounds
16which comprise all or part of a university, a center an institution or the extension.
SB288, s. 12 17Section 12. 36.05 (4) of the statutes is renumbered 36.05 (6m) and amended
18to read:
SB288,6,2019 36.05 (6m) "Center "College campus" means any one of the 2-year collegiate
20campuses of the system.
SB288, s. 13 21Section 13. 36.05 (9) of the statutes is amended to read:
SB288,6,2322 36.05 (9) "Institution" means any university or an organizational equivalent
23designated by the board and the University of Wisconsin colleges.
SB288, s. 14 24Section 14. 36.05 (14) of the statutes is created to read:

136.05 (14) "University of Wisconsin Colleges" means the college campuses as
2a whole.
SB288, s. 15 3Section 15. 36.09 (1) (e) of the statutes is amended to read:
SB288,7,164 36.09 (1) (e) The board shall appoint a president of the system; a chancellor for
5each institution; a dean for each center college campus; the state geologist; the
6director of the laboratory of hygiene; the director of the psychiatric institute; the
7state cartographer with the advice of the land information board; and the requisite
8number of officers, other than the vice presidents, associate vice presidents and
9assistant vice presidents of the system; faculty; academic staff and other employes
10and fix the salaries, subject to the limitations under par. (j) and ss. 20.923 (4), (4m)
11and (5) and 230.12 (3) (e), the duties and the term of office for each. The board shall
12fix the salaries, subject to the limitations under par. (j) and ss. 20.923 (4), (4m) and
13(5) and 230.12 (3) (e), and the duties for each chancellor, vice president, associate vice
14president and assistant vice president of the system. No sectarian or partisan tests
15or any tests based upon race, religion, national origin or sex shall ever be allowed or
16exercised in the appointment of the employes of the system.
SB288, s. 16 17Section 16. 36.09 (1) (h) of the statutes is amended to read:
SB288,8,218 36.09 (1) (h) The board shall allocate funds and adopt budgets for the respective
19institutions giving consideration to the principles of comparable budgetary support
20for similar programs and equitable compensation for faculty and academic staff with
21comparable training, experience and responsibilities and recognizing competitive
22ability to recruit and retain qualified faculty and academic staff. If the board ceases
23or suspends operation of any institution or center college campus, the appropriations
24to the board for operation of the institution or center college campus may be utilized

1by the board for any other purpose authorized by the appropriations within the
2period for which the appropriations are made.
SB288, s. 17 3Section 17. 36.11 (8e) of the statutes is amended to read:
SB288,8,124 36.11 (8e) Parking fees. The board shall direct each institution and center
5within the system to charge a parking fee for the parking of motor vehicles by
6students, faculty, academic and classified staff and visitors at campus. The board
7shall require the fee to be sufficient to recover the costs of the construction and
8maintenance necessary for the parking facilities. Nothing in this paragraph shall
9be deemed to require the recovery of the costs of land for parking facilities. Nothing
10in this paragraph shall be deemed to require that all users of the parking facilities
11be charged a parking fee. Center College campus facilities owned by a county are not
12required to charge a parking fee.
SB288, s. 18 13Section 18. 36.11 (16) of the statutes is amended to read:
SB288,8,1714 36.11 (16) Commencement of fall semester. The board shall ensure that no
15fall semester classes at any center or institution within the system, except medical
16school classes and 4th year classes at the school of veterinary medicine, commence
17until after September 1.
SB288, s. 19 18Section 19. 36.11 (21) of the statutes is amended to read:
SB288,9,219 36.11 (21) Controlled substances and controlled substance analogs;
20discipline.
Any student who engages in an activity, on campus or at an event
21sponsored by a center college campus or institution or by the system, that constitutes
22a violation of ch. 961 is subject to nonacademic misconduct disciplinary sanctions,
23as provided by the board by rule. In determining the appropriate sanction, the board
24or its designee shall consider those penalties, including suspension and expulsion,
25that will contribute most effectively to maintaining a system environment that is

1free from controlled substances, as defined in s. 961.01 (4), and controlled substance
2analogs, as defined in s. 961.01 (4m).
