SB311,1,2 1An Act to amend 753.075 (2) (a) and (b); and to create 753.075 (2m) of the
2statutes; relating to: reserve judge qualifications.

Under current law, former judges and justices serve at the request of the chief
justice of the supreme court as temporary reserve judges on a day-by-day basis or
as permanent reserve judges for a period of 6 months. To be eligible to serve as a
reserve judge under current law, the person has to have served for 6 or more years
as a supreme court justice, court of appeals judge or circuit judge. In addition under
current law, any person who was eligible to serve as a reserve judge before May 1,
1992, may serve as a reserve judge.
Under this bill, in addition to the current restrictions, a person is not eligible
to serve as a reserve judge if he or she was defeated at the most recent time that he
or she sought election to a circuit court judgeship. The bill also provides that a person
eligible to serve as a reserve judge on the effective date of the bill will continue to be
eligible to serve as a reserve judge. This provision "grandfathers" in persons
currently eligible to serve as a reserve judge.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB311, s. 2 4Section 2. 753.075 (2m) of the statutes is created to read:
SB311,2,75 753.075 (2m) Eligibility exception. A person who is eligible to serve as a
6reserve judge on the effective date of this subsection .... [revisor inserts date],
7continues to be eligible to serve as a reserve judge notwithstanding sub. (2).
