2relating to: release of patient health care records to the patient's health care

Analysis by the Legislative Reference Bureau
Under current law, no person may conceal or withhold a patient health care
record with the intent to prevent its release to the patient, to the patient's guardian
or to a person who has the informed consent of the patient.
This bill provides that no person may conceal or withhold a patient health care
record with the intent to prevent its release to the patient's health care provider with
the informed consent of the patient.
The bill also requires that a copy of a patient's health care records be released
without charge to the patient's health care provider upon request with a statement
of informed consent.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB319, s. 1 4Section 1. 146.83 (1m) of the statutes is created to read:

1146.83 (1m) Notwithstanding sub. (1) (b), a patient's health care records shall
2be provided without charge to the patient's health care provider upon request with
3a statement of informed consent.
SB319, s. 2 4Section 2. 146.83 (4) (b) of the statutes is amended to read:
