SB322,1,5 1An Act to repeal 15.406 (2) (b), 440.03 (10) and 448.72 (2); to renumber 15.406
2(2) (a); to renumber and amend 448.72 (1); and to amend 146.81 (1) (em),
3180.1901 (1m) (br), 252.10 (7), 252.14 (1) (ar) 4m., 440.08 (2) (a) 27m., 448.76,
4450.10 (3) (a) 5m., 632.895 (1) (b) 5. b., 655.45 (1m) and 655.45 (2) (intro.) of the
5statutes; relating to: certification requirements for dietitians.
Analysis by the Legislative Reference Bureau
Under current law, with certain exceptions, a person may not represent that he
or she is a dietitian or use a similar title unless he or she is issued a certificate by the
dietitians affiliated credentialing board in the department of regulation and
licensing. To be eligible for a certificate, a person must satisfy certain educational
and practical requirements and pass an examination. The provisions under current
law pertaining to the certification of dietitians do not apply after June 30, 1999. This
bill repeals that sunset date.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB322, s. 1 6Section 1. 15.406 (2) (a) of the statutes is renumbered 15.406 (2).
SB322, s. 2 7Section 2. 15.406 (2) (b) of the statutes is repealed.
SB322, s. 3 8Section 3. 146.81 (1) (em) of the statutes is amended to read:

1146.81 (1) (em) A dietitian certified under subch. IV of ch. 448. This paragraph
2does not apply after June 30, 1999.
SB322, s. 4 3Section 4. 180.1901 (1m) (br) of the statutes is amended to read:

5ch. 448. This paragraph does not apply after June 30, 1999.
SB322, s. 5 6Section 5. 252.10 (7) of the statutes is amended to read:
SB322,2,157 252.10 (7) Drugs necessary for the treatment of mycobacterium tuberculosis
8shall be purchased by the department from the appropriation under s. 20.435 (1) (e)
9and dispensed to patients through the public health dispensaries or through health
10care providers, as defined in s. 146.81 (1), other than social workers, marriage and
11family therapists or professional counselors certified under ch. 457,
12speech-language pathologists or audiologists licensed under subch. II of ch. 459,
13speech and language pathologists licensed by the department of education public
14instruction
or, on or after July 1, 1995, and no later than June 30, 1999, dietitians
15certified under subch. IV of ch. 448.
SB322, s. 6 16Section 6. 252.14 (1) (ar) 4m. of the statutes is amended to read:

SB322, s. 9 23Section 9. 448.72 (1) of the statutes is renumbered 448.72, and 448.72 (1) (b),
24(2) and (3), as renumbered, are amended to read:

2under subd. 1 par. (a).
SB322,3,5 3(2) Prohibit a dietetic student described in par. (a) 3. sub. (1) (c) from using the
4title "dietitian student" or any other title, letters or designation that clearly indicates
5his or her status as a student or trainee.
SB322,3,9 6(3) Prohibit an individual described in par. (a) 5. sub. (1) (e) from using the title
7"dietitian" or any letters or designation that represents or may tend to represent the
8individual as a dietitian, if the title, letters or designation is used only in the course
9of the individual's service or employment.
SB322, s. 10 10Section 10. 448.72 (2) of the statutes is repealed.
SB322, s. 11 11Section 11. 448.76 of the statutes is amended to read:
SB322,3,16 12448.76 Use of titles. Except as provided in s. 448.72 (1) (a) 5. (e) and (b) (2)
13to (f) (6), a person who is not a certified dietitian may not designate himself or herself
14as a dietitian, claim to provide dietetic services or use any title or initials that
15represent or may tend to represent the person as certified or licensed as a dietitian
16or as certified or licensed in a nutrition-related field.
SB322, s. 12 17Section 12. 450.10 (3) (a) 5m. of the statutes is amended to read:

19subdivision does not apply after June 30, 1999.

SB322, s. 14 24Section 14. 655.45 (1m) of the statutes is amended to read:

1655.45 (1m) For the quarter beginning on July 1, 1995, and for each quarter
2thereafter until the quarter ending June 30, 1999, the director of state courts shall
3file reports complying with sub. (2) with the dietitians affiliated credentialing board
4regarding health care providers certified by the dietitians affiliated credentialing
5board.
