SB395,1,2 1An Act to renumber 30.056; and to create 30.056 (2) of the statutes; relating
2to:
a structure in the Rock River in the city of Beloit.
Analysis by the Legislative Reference Bureau
No person may place structures or deposits or engage in certain other activities
that affect navigable waters without having a permit issued by the department of
natural resources. Most types of structures require some type of permit, the major
exception being piers and wharves that meet certain requirements. The types of
activities requiring permits include grading or removing soil from a bank of a stream,
constructing or enlarging certain artificial waterways and changing the courses of
rivers or streams. Under current law, a structure that is in violation of these
permitting requirements is a public nuisance and a district attorney or the state's
attorney general may bring an action to require that the structure be removed.
Under this bill, a structure and any activity engaged in order to maintain the
structure that was placed in the Rock River in the city of Beloit before January 1,
1967, is exempt from the permitting requirements described above. Additionally,
under the bill, no person may be required to remove the structure from the Rock
River.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB395,2,73 30.056 (2) Notwithstanding ss. 30.12, 30.19, 30.195 and 30.294, no person may
4be required to remove any structure that was placed in the Rock River in the city of
5Beloit before January 1, 1967, and the owner of the structure may continue to
6maintain the structure without having a permit or other approval from the
7department.
