SB403,1,3 1An Act to create 121.78 (5) of the statutes; relating to: the payment of tuition
2at public school for pupils residing in certain foster, treatment foster or group

Under current law, the state pays tuition for a pupil attending a public school
if the pupil is in a foster home, treatment foster home or group home that is located
outside the school district in which the pupil's parent or guardian resides and is
exempted from property taxation.
This bill provides that, if a pupil is placed in a foster, treatment foster or group
home that is located outside the school district in which the pupil's parent or
guardian resides and that is not exempted from property taxation, the school board
of the school district in which the pupil resided immediately prior to the placement
must pay public school tuition for the pupil. The latter school district counts the
pupil in enrollment for state aid purposes.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB403, s. 1 4Section 1. 121.78 (5) of the statutes is created to read:
SB403,2,35 121.78 (5) Pupils in certain homes. If a pupil is placed in a foster, treatment
6foster or group home that is located outside the school district in which the pupil's

1parent or guardian resides and that is not exempted from property taxation under
2s. 70.11, the school board of the school district in which the pupil resided immediately
3prior to the placement shall pay tuition for the pupil.
