AB165,1,4 1An Act to amend 20.235 (1) (fe) and 20.285 (4) (dd); and to create 36.34 (1) (c)
2and 39.435 (7) of the statutes; relating to: making an appropriation for the
3Wisconsin higher education and Lawton minority undergraduate grant
4programs.

Current law specifies a sum certain in each fiscal year for the amount
appropriated for certain higher education grants awarded by the higher educational
aids board and for certain minority undergraduate grants awarded by the board of
regents of the University of Wisconsin System (board of regents).
Under this bill, the amount appropriated in each fiscal year for both types of
grants depends on whether undergraduate tuition at institutions within the
University of Wisconsin System in the current academic year has increased or
decreased as compared to the previous academic year. By February 1 before the
beginning of the next fiscal year, the higher educational aids board and the board of
regents are required to determine the percentage of such an increase at each such
institution. The appropriation for the next fiscal year is determined by increasing
the amount of the appropriation in the current fiscal year by the highest percentage
increase. If tuition has decreased or stayed the same at each such institution, the
appropriation for the next fiscal year is the amount appropriated in the current fiscal
year.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB165, s. 1 1Section 1. 20.235 (1) (fe) of the statutes is amended to read:
AB165,2,62 20.235 (1) (fe) Wisconsin higher education grants; University of Wisconsin
3System students.
Biennially, the amounts in the schedule A sum sufficient equal to
4the amount determined under s. 39.435 (7)
for the Wisconsin higher education grant
5program under s. 39.435 for University of Wisconsin System students, except for
6grants awarded under s. 39.435 (2) or (5).
AB165, s. 2 7Section 2. 20.285 (4) (dd) of the statutes is amended to read:
AB165,2,108 20.285 (4) (dd) Lawton minority undergraduate grants program. The amounts
9in the schedule
A sum sufficient equal to the amount determined under s. 36.34 (1)
10(c)
for the Lawton minority undergraduate grant program under s. 36.34 (1).
AB165, s. 3 11Section 3. 36.34 (1) (c) of the statutes is created to read:
AB165,2,1212 36.34 (1) (c) 1. In this paragraph:
AB165,2,1513 a. For purposes of determining the appropriation under s. 20.285 (4) (dd) for
14fiscal year 2000-01, "base amount" means the amount shown in the schedule under
15s. 20.005 for that appropriation for fiscal year 1999-2000.
AB165,2,1816 b. For purposes of determining the appropriation under s. 20.285 (4) (dd) for
17each fiscal year after fiscal year 2000-01, "base amount" means the appropriation
18determined under subd. 2. for the previous fiscal year.
AB165,2,2019 2. Annually, by February 1, the board shall determine the appropriation under
20s. 20.285 (4) (dd) for the next fiscal year as follows:

1a. The board shall determine the percentage by which the undergraduate
2academic fees charged for the current academic year at each institution within the
3University of Wisconsin System has increased or decreased from the undergraduate
4academic fees charged for the previous academic year.
AB165,3,105 b. The appropriation for the next fiscal year shall be the result obtained by
6increasing, to the nearest $100, the base amount by the highest percentage increase
7determined under subd. 2. a., except that if the undergraduate academic fees for the
8current academic year decreased or did not change from the undergraduate
9academic fees charged for the previous academic year at each institution specified
10in subd. 2. a., the appropriation shall be the base amount.
AB165, s. 4 11Section 4. 39.435 (7) of the statutes is created to read:
AB165,3,1212 39.435 (7) (a) In this subsection:
AB165,3,1513 1. For purposes of determining the appropriation under s. 20.235 (1) (fe) for
14fiscal year 2000-01, "base amount" means the amount shown in the schedule under
15s. 20.005 for that appropriation for fiscal year 1999-2000.
AB165,3,1816 2. For purposes of determining the appropriation under s. 20.235 (1) (fe) for
17each fiscal year after fiscal year 2000-01, "base amount" means the maximum
18appropriation amount determined under par. (b) for the previous fiscal year.
AB165,3,2019 (b) Annually, by February 1, the board shall determine the appropriation under
20s. 20.235 (1) (fe) for the next fiscal year as follows:
AB165,3,2421 1. The board shall determine the percentage by which the undergraduate
22academic fees charged for the current academic year at each institution within the
23University of Wisconsin System has increased or decreased from the undergraduate
24academic fees charged for the previous academic year.

12. The appropriation for the next fiscal year shall be the result obtained by
2increasing, to the nearest $100, the base amount by the highest percentage increase
3determined under subd. 1., except that if the undergraduate academic fees for the
4current academic year decreased or did not change from the undergraduate
5academic fees charged for the previous academic year at each institution specified
6in subd. 1., the appropriation shall be the base amount.
AB165, s. 5 7Section 5. Effective dates. This act takes effect on July 1, 1999, or on the day
8after publication, whichever is later, except as follows:
AB165,4,109 (1) The treatment of sections 20.235 (1) (fe) and 20.285 (4) (dd) of the statutes
10takes effect on July 1, 2000.
