AB30,1,4 1An Act to create 196.633 of the statutes; relating to: prohibiting
2telecommunications providers from using social security numbers of customers
3for purposes related to providing telecommunications services and providing a
4penalty.
Analysis by the Legislative Reference Bureau
This bill prohibits a telecommunications provider, including a person who
provides cable television service, from requiring a customer to provide his or her
social security number to the telecommunications provider for any purpose that is
related to providing telecommunications services to the customer. The bill also
prohibits a telecommunications provider from using a customer's social security
number for the same purpose. In addition, the bill allows the public service
commission, on its own motion or the filing of a complaint by any person, to
commence an action in court to enforce the bill's prohibitions. A telecommunications
provider that violates the bill's prohibitions is subject to a forfeiture of between $25
and $5,000.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB30, s. 1
1Section 1. 196.202 (2) of the statutes is amended to read:
AB30,2,102 196.202 (2) Scope of regulation. A commercial mobile radio service provider
3is not subject to ch. 200 or this chapter, except a commercial mobile radio service
4provider is subject to s. 196.209 (6), and subject to s. 196.218 (3) to the extent not
5preempted by federal law. If the application of s. 196.218 (3) to a commercial mobile
6radio service provider is not preempted, a commercial mobile radio service provider
7shall respond, subject to the protection of the commercial mobile radio service
8provider's competitive information, to all reasonable requests for information about
9its operations in this state from the commission necessary to administer the
10universal service fund.
AB30, s. 2 11Section 2. 196.203 (3) (dm) of the statutes is created to read:
AB30,2,1312 196.203 (3) (dm) Section 196.209 (6) applies to an alternative
13telecommunications utility.
AB30, s. 3 14Section 3. 196.209 (title) of the statutes is amended to read:
AB30,2,15 15196.209 (title) Privacy considerations; social security numbers.
AB30, s. 4 16Section 4. 196.209 (4) (intro.) of the statutes is amended to read:
AB30,2,1917 196.209 (4) Scope. (intro.) Rules promulgated by the commission under this

sub. (1) and privacy considerations addressed by a telecommunications
19provider shall include all of the following:

AB30,2,2321 196.209 (5) (b) The telecommunications privacy council shall advise the
22commission concerning the administration of this section subs. (1) to (4) and the
23content of rules promulgated under this section sub. (1).
AB30, s. 6 24Section 6. 196.209 (6) of the statutes is created to read:
AB30,2,2525 196.209 (6) Social security numbers. (a) In this subsection:

11. "Customer" means an individual to whom a telecommunications provider
2provides a telecommunications service.
AB30,3,33 2. "Telecommunications service" includes cable television service.
AB30,3,64 (b) 1. A telecommunications provider may not require a customer to provide his
5or her social security number to the telecommunications provider for any purpose
6that is related to the provision of a telecommunications service to the customer.
AB30,3,97 2. A telecommunications provider may not use the social security number of a
8customer for any purpose that is related to the provision of a telecommunications
9service to the customer.
AB30,3,1210 (c) The commission may, upon its own motion or the filing of a complaint by any
11person, commence an action against a telecommunications provider to enforce this
12subsection.
AB30,3,1413 (d) A telecommunications provider who violates this subsection shall forfeit not
14less than $25 nor more than $5,000.
AB30, s. 7 15Section 7. Effective date.
AB30,3,1716 (1) This act takes effect on the first day of the 2nd month beginning after
17publication.
