AB340,1,4 1An Act to amend 230.15 (1); and to create 36.11 (27), 39.28 (6), 230.143, 343.06
2(1) (L) and 343.14 (2) (em) of the statutes; relating to: restrictions on issuing
3operator's licenses, state employment and student financial assistance based
4on failure to register with the selective service system.

Under this bill, a person who is required under federal law to register with the
selective service system, but has not done so, may not be appointed to a position in
the state classified service, to certain positions in the University of Wisconsin (UW)
System available to students or as a corps enrollee in the Wisconsin conservation
corps. The bill first applies to original appointments made on the first day of the 13th
month beginning after the bill's effective date.
The bill prohibits the board of regents of the UW System and the higher
educational aids board from providing any state financial assistance to a person who
is required to register with the selective service system and has not done so.
The bill prohibits the department of transportation from issuing an operator's
license to a person who is required to register with the selective service system and
has not done so.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB340, s. 1 1Section 1. 36.11 (27) of the statutes is created to read:
AB340,2,52 36.11 (27) Condition on financial assistance. The board may not provide any
3state financial assistance under this chapter to any person during the period that the
4person is required to register with the selective service system under 50 USC 451 to
5473 if the person has not so registered.
AB340, s. 2 6Section 2. 39.28 (6) of the statutes is created to read:
AB340,2,107 39.28 (6) The board may not provide any state financial assistance under this
8subchapter to any person during the period that the person is required to register
9with the selective service system under 50 USC 451 to 473 if the person has not so
10registered.
AB340, s. 3 11Section 3. 230.143 of the statutes is created to read:
AB340,2,15 12230.143 Appointment; selective service registration. A person who is
13required to register with the selective service system under 50 USC 451 to 473, but
14has not registered, may not receive any of the following during the period that the
15person is required to register:
AB340,2,16 16(1) An original appointment to a position in the classified service.
AB340,2,17 17(2) An appointment to a position described in s. 230.08 (2) (k).
AB340,2,19 18(3) An appointment to a position as a corps enrollee with the Wisconsin
19conservation corps program under s. 106.215 (1) (c).
AB340, s. 4 20Section 4. 230.15 (1) of the statutes is amended to read:

1230.15 (1) Appointments Subject to the restriction under s. 230.143,
2appointments
to, and promotions in, the classified service shall be made only
3according to merit and fitness, which shall be ascertained so far as practicable by
4competitive examination. The administrator may waive competitive examination
5for appointments made under subs. (1m) and (2) and shall waive competitive
6examination for appointments made under sub. (2m).
AB340, s. 5 7Section 5. 343.06 (1) (L) of the statutes is created to read:
AB340,3,108 343.06 (1) (L) To any person during the period that the person is required to
9register with the selective service system under 50 USC 451 to 473 if the person has
10not so registered.
AB340, s. 6 11Section 6. 343.14 (2) (em) of the statutes is created to read:
AB340,3,1412 343.14 (2) (em) Whether or not the applicant is required to register with the
13selective service system under 50 USC 451 to 473 and, if so, whether or not the
14applicant has done so;
AB340, s. 7 15Section 7. Initial applicability.
AB340,3,1816 (1) The treatment of sections 230.143 and 230.15 (1) of the statutes first applies
17to appointments made on the first day of the 13th month beginning after the effective
18date of this subsection.
AB340, s. 8 19Section 8. Effective date.
AB340,3,2020 (1) This act takes effect on January 1, 2000.
