AB506,1,3 1An Act to amend 95.60 (3) and 95.60 (3m) of the statutes; relating to: the
2requirement that certain operators of fish farms obtain annual health
3certificates.
Analysis by the Legislative Reference Bureau
Current law requires a person who operates a fish farm to annually register the
fish farm with the department of agriculture, trade and consumer protection
(DATCP). Current law also requires the operator of a fish farm to annually obtain
a fish health certificate for any fish eggs present or any fish reared on the fish farm,
except that an operator who does not sell, distribute or release live fish or fish eggs
may rely on the health certificate of the person from whom the operator obtained fish
or fish eggs.
This bill eliminates the absolute requirement to obtain a fish health certificate
and instead authorizes DATCP to require a fish farm operator to obtain an annual
fish health certificate.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB506, s. 1 4Section 1. 95.60 (3) of the statutes is amended to read:

195.60 (3) A The department may promulgate a rule requiring a person who
2operates a fish farm shall to obtain an annual health certificate from a veterinarian
3licensed under ch. 453 or from a person who is qualified to issue fish health
4certificates under sub. (4s) (c) for any fish eggs present or any fish reared on the fish
5farm, except that. If the department promulgates a rule under this subsection, the
6rule may allow
a fish farm operator who does not sell, distribute or release live fish
7or fish eggs from the fish farm may to rely upon health certificates under this
8subsection that are obtained by the person from whom the fish farm operator receives
9fish or fish eggs.
AB506, s. 2 10Section 2. 95.60 (3m) of the statutes is amended to read:
AB506,2,1511 95.60 (3m) A person who operates a fish farm shall annually register the fish
12farm with the department. The person registering the fish farm shall provide
13evidence of the any health certificate required under sub. (3) and shall identify the
14activities that will be engaged in, the species of fish that will be used and the facilities
15that will be used on the fish farm.
AB506, s. 3 16Section 3. Effective date.
AB506,2,1817 (1) This act takes effect on the first day of the 13th month beginning after
18publication.
