AB764,1,4 An Act to renumber and amend 38.04 (4) (e), 115.28 (11) and 343.61 (6); and to create 38.04 (4) (e) 2., 115.28 (11) (b) and 343.61 (6) (b) of the statutes; relating to: requiring driver education courses to include instruction pertaining to organ and tissue donation.

Analysis by the Legislative Reference Bureau

This bill requires all driver education courses offered by school districts, county children with disabilities education boards, technical college districts and driver schools to include at least 30 minutes of instruction relating to organ and tissue donation and organ and tissue donation procedures.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB764, s. 1 Section 1. 38.04 (4) (e) of the statutes is renumbered 38.04 (4) (e) (intro.) and amended to read:

AB764,1,8 38.04 (4) (e) (intro.) No driver education course may be approved by the board unless it acquaints does all of the following:

AB764,2,2 1. Acquaints each student with the hazards posed by machinery and animals on highways and provides instruction in safely dealing with such hazards.

AB764, s. 2 Section 2. 38.04 (4) (e) 2. of the statutes is created to read:

AB764,2,5 38.04 (4) (e) 2. Provides at least 30 minutes of instruction relating to organ and tissue donation and organ and tissue donation procedures.

AB764, s. 3 Section 3. 115.28 (11) of the statutes is renumbered 115.28 (11) (intro.) and amended to read:

AB764,2,14 115.28 (11) Driver education courses. (intro.) Approve driver education courses offered by school districts, county children with disabilities education boards and technical college districts for the purposes of ss. 121.41 (1) and 343.16 (1) (c) 1. and establish minimum standards for driver education courses offered in private schools for the purposes of s. 343.16 (1) (c) 3. All driver education courses approved or for which standards are established under this subsection shall acquaint do all of the following:

AB764,2,17 (a) Acquaint each student with the hazards posed by farm machinery and animals on highways and by railroad grade crossings and shall provide instruction in safely dealing with such hazards.

AB764, s. 4 Section 4. 115.28 (11) (b) of the statutes is created to read:

AB764,2,20 115.28 (11) (b) Provide at least 30 minutes of instruction relating to organ and tissue donation and organ and tissue donation procedures.

AB764, s. 5 Section 5. 343.61 (6) of the statutes is renumbered 343.61 (6) (intro.) and amended to read:

AB764,2,24 343.61 (6) (intro.) No driver school may be licensed unless its approved course of instruction acquaints does all of the following:

AB764,3,2 (a) Acquaints each student with the hazards posed by farm machinery and animals on highways and provides instruction in safely dealing with such hazards.

AB764, s. 6 Section 6. 343.61 (6) (b) of the statutes is created to read:

AB764,3,5 343.61 (6) (b) Provides at least 30 minutes of instruction relating to organ and tissue donation and organ and tissue donation procedures.

AB764, s. 7 Section 7. Initial applicability.

AB764,3,8 (1) This act first applies to driver education courses that are begun on July 1, 2000.
