AB804,1,4 1An Act to repeal 16.54 (11m), 20.370 (5) (dd) and 20.370 (5) (ds); to amend
220.370 (5) (bx); and to create 20.370 (5) (dd), 20.370 (5) (ds) and 59.25 (3) (rm)
3of the statutes; relating to: distribution of national forest income payments
4from the federal government and making appropriations.
Analysis by the Legislative Reference Bureau
Under current law, all money received by the state from receipts on national
forest lands must be distributed to school districts in accordance with the number of
acres of national forest land located within the school district boundaries. This
requirement was imposed by 1999 Wisconsin Act 9 (the biennial budget bill). Before
the enactment of 1999 Wisconsin Act 9, all money received by the state from receipts
on national forest lands was required to be distributed to towns in accordance with
the number of acres of national forest land located within the town boundaries. Any
town that received any of these moneys was required to expend at least 50% of the
moneys on public roads in the town. This bill restores the law to the way it was before
the enactment of 1999 Wisconsin Act 9.
In addition, the bill requires the secretary of natural resources to make a
one-time distribution of $1,805,800 to school districts that contain national forest
lands within their boundaries. Of these moneys, $1,400,000 is taken from the
conservation fund and $405,800 is taken from the general fund. The distribution to
each school district must reflect the proportion of national forest acreage located
within the school district.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB804, s. 1 1Section 1. 16.54 (11m) of the statutes, as created by 1999 Wisconsin Act 9, is
2repealed.
AB804, s. 2 3Section 2. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
4the following amounts for the purposes indicated: - See PDF for table PDF
AB804, s. 3 5Section 3. 20.370 (5) (bx) of the statutes, as affected by 1999 Wisconsin Act 9,
6is amended to read:
AB804,2,137 20.370 (5) (bx) Resource aids — national forest income aids. All moneys
8received from the U.S. government for allotments to school districts counties
9containing national forest lands, and designated for the benefit of public roads in
10such counties,
shall be distributed in proportion to the national forest acreage in each
11school district county as certified by the U.S. forest service. Such distribution shall
12be made annually within 60 days after receipt of the money from the federal
13government.

1Section 4. 20.370 (5) (dd) of the statutes is created to read:
AB804,3,42 20.370 (5) (dd) Payments to certain school districts; general fund. From the
3general fund, the amounts in the schedule to make the payments required under

AB804, s. 8 12Section 8 . 59.25 (3) (rm) of the statutes is created to read:
AB804,3,1813 59.25 (3) (rm) If the treasurer's county receives national forest income,
14distribute the income to the towns in the county in which national forest lands are
15situated, with each town to receive such proportion of the income as the area of
16national forest lands in the town bears to the area of the national forest lands in the
17entire county. Fifty percent of the amount received by any town shall be expended
18by the town exclusively for the benefit of roads therein.
AB804, s. 9 19Section 9 . Nonstatutory provisions.
AB804,4,420 (1) Payments to certain school districts. No later than June 30, 2000, the
21secretary of natural resources shall distribute $405,800 from the appropriation
22account under section 20.370 (5) (dd) of the statutes, as created by this act, and
23$1,400,000 from the appropriation account under section 20.370 (5) (ds) of the
24statutes, as created by this act, to school districts that contain national forest lands
25within their boundaries. The distribution to each school district shall reflect the

1proportion of national forest acreage located within the school district. The secretary
2of natural resources shall distribute the payments to school districts from the
3appropriation under section 20.370 (5) (ds) of the statutes, as created by this act, from
4the amounts in the conservation fund under section 25.29 (1) (c) of the statutes.
AB804, s. 10 5Section 10. Appropriation changes.
AB804,4,106 (1) Joint committee on finance. In the schedule under section 20.005 (3) of the
7statutes for the appropriation to the joint committee on finance under section 20.865
8(4) (a) of the statutes, as affected by the acts of 1999, the dollar amount is decreased
9by $405,800 for fiscal year 1999-00 to decrease funding for the purposes for which
10the appropriation is made.
AB804, s. 11 11Section 11. Effective dates. This act takes effect on the day after publication,
12except as follows:
AB804,4,1413 (1) Payments to certain school districts. The repeal of section 20.370 (5) (dd)
14and (ds) of the statutes takes effect on July 1, 2000.
