AB864,1,4 1An Act to repeal 16.54 (11m) and 20.370 (5) (dd); to amend 20.370 (5) (bx); and
2to create 20.370 (5) (dd) and 59.25 (3) (rm) of the statutes; relating to:
3distribution of national forest income payments from the federal government
4and making appropriations.
Analysis by the Legislative Reference Bureau
Under current law, all money received by the state from receipts on national
forest lands must be distributed to school districts in accordance with the number of
acres of national forest land located within the school district boundaries. This
requirement was imposed by 1999 Wisconsin Act 9 (the biennial budget bill). Before
the enactment of 1999 Wisconsin Act 9, all money received by the state from receipts
on national forest lands was required to be distributed to towns in accordance with
the number of acres of national forest land located within the town boundaries. Any
town that received any of these moneys was required to expend at least 50% of the
moneys on public roads in the town. This bill restores the law to the way it was before
the enactment of 1999 Wisconsin Act 9.
In addition, the bill requires the secretary of natural resources to make a
one-time distribution of $1,805,800 to school districts that contain national forest
lands within their boundaries. The distribution to each school district must reflect
the proportion of national forest acreage located within the school district.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB864, s. 1 1Section 1. 16.54 (11m) of the statutes, as created by 1999 Wisconsin Act 9, is
2repealed.
AB864, s. 2 3Section 2. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
4the following amounts for the purposes indicated: - See PDF for table PDF
AB864, s. 3 5Section 3. 20.370 (5) (bx) of the statutes, as affected by 1999 Wisconsin Act 9,
6is amended to read:
AB864,2,137 20.370 (5) (bx) Resource aids — national forest income aids. All moneys
8received from the U.S. government for allotments to school districts counties
9containing national forest lands, and designated for the benefit of public roads in
10such counties,
shall be distributed in proportion to the national forest acreage in each
11school district county as certified by the U.S. forest service. Such distribution shall
12be made annually within 60 days after receipt of the money from the federal
13government.
AB864, s. 4 14Section 4. 20.370 (5) (dd) of the statutes is created to read:

120.370 (5) (dd) Payments to certain school districts. From the general fund, the
2amounts in the schedule to make the payments required under 1999 Wisconsin Act

AB864, s. 6 6Section 6. 59.25 (3) (rm) of the statutes is created to read:
AB864,3,127 59.25 (3) (rm) If the treasurer's county receives national forest income,
8distribute the income to the towns in the county in which national forest lands are
9situated, with each town to receive such proportion of the income as the area of
10national forest lands in the town bears to the area of the national forest lands in the
11entire county. Fifty percent of the amount received by any town shall be expended
12by the town exclusively for the benefit of roads therein.
AB864, s. 7 13Section 7 . Nonstatutory provisions.
AB864,3,1914 (1) Payments to certain school districts. No later than June 30, 2000, the
15secretary of natural resources shall distribute $1,805,800 from the appropriation
16account under section 20.370 (5) (dd) of the statutes, as created by this act, to school
17districts that contain national forest lands within their boundaries. The distribution
18to each school district shall reflect the proportion of national forest acreage located
19within the school district.
AB864, s. 8 20Section 8. Effective dates. This act takes effect on the day after publication,
21except as follows:
AB864,3,2322 (1) Payments to certain school districts. The repeal of section 20.370 (5) (dd)
23of the statutes takes effect on July 1, 2000.
