SB103,1,2 1An Act to create 29.335 of the statutes; relating to: attracting wild animals
2with bait and granting rule-making authority.

Current rules promulgated by the department of natural resources (DNR)
restrict the types and locations of bait that may be used for the hunting of certain wild
animals. This bill prohibits the use of bait for the purpose of hunting deer during the
period beginning on the Monday immediately before the first day of regular gun deer
season and ending on the Friday immediately following the last day of regular gun
deer season.
This bill also prohibits a person from using bait to attract wild animals more
than 100 yards from a residence for a purpose other than hunting unless the person
has a permit issued by DNR. The bill requires DNR to establish requirements and
procedures for issuing these permits and prohibits DNR from charging a fee for these
permits.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB103, s. 1 3Section 1. 29.335 of the statutes is created to read:

129.335 Use of bait. (1) Definition. In this section, "regular gun deer season"
2means the deer hunting season established by the department that begins in
3November and that authorizes hunting with firearms other than muzzle-loaders.
SB103,2,7 4(2) Bait for hunting deer. No person may place or use bait for the purpose of
5hunting deer during the period beginning on the Monday immediately before the
6first day of regular gun deer season and ending on the Friday immediately following
7the last day of the regular gun deer season.
SB103,2,10 8(3) Bait for nonhunting purposes. (a) No person may place or use bait more
9than 100 yards from a residence to attract wild animals for purposes other than
10hunting unless the person holds a permit issued by the department under par. (b).
SB103,2,1411 (b) The department shall promulgate rules to establish requirements and
12procedures for issuing permits that authorize the placement or use of bait more than
13100 yards from residences to attract wild animals for purposes other than hunting.
14The department may not charge a fee for these permits.
