SB492,1,2 1An Act relating to: federal funding for railroad crossing protection
2improvements.

Under current law, the secretary of transportation is required to submit to the
joint committee on finance (JCF) a proposed plan to adjust appropriations of federal
funds to the department of transportation (DOT) for a fiscal year if the most recent
estimate of federal funds available to DOT for that fiscal year is less than 95% or
more than 105% of the amount shown in the appropriation schedule for federal funds
appropriated to DOT. If, within 14 days after the cochairpersons of JCF determine
that the proposed plan is complete, JCF does not meet to review the plan, the
secretary of transportation shall implement the plan. If JCF meets and approves,
or modifies and approves, the proposed plan, the secretary of transportation shall
implement the approved plan.
This bill provides that, if the most recent estimate of federal funds available to
DOT for the 2000-01 fiscal year is more than 105% of the amount of federal funds
shown in the appropriation schedule for federal funds appropriated to DOT for that
fiscal year, the secretary of transportation shall include in the proposed plan
submitted to JCF an adjustment that reflects an increase of $2,000,000 to the
expenditure estimate of federal funds in the 2000-01 fiscal year to pay the costs for
certain railroad crossing protection improvements.
The bill also provides that, if the most recent estimate of federal funds available
to DOT for the 2000-01 fiscal year is more than 100% but not more than 105% of the
amount of federal funds shown in the appropriation schedule for federal funds

appropriated to DOT for that fiscal year, the secretary of transportation shall, before
making any other adjustments, make an adjustment that reflects an increase by the
amount that such federal funds available to DOT exceeds 100% or by $2,000,000,
whichever is less, to the expenditure estimate of federal funds in the 2000-01 fiscal
year to pay the costs for certain railroad crossing protection improvements.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB492,2,33 (a) In this subsection:
SB492,2,5 41. "Amount of federal funds" has the meaning given in section 84.03 (2) (a) 1.
5of the statutes.
SB492,2,7 62. "The schedule" has the meaning given in section 84.03 (2) (a) 2. of the
7statutes.
SB492,2,158 (b) If the department of transportation's most recent estimate of the amount
9of federal funds that the department will expend under section 20.395 of the statutes
10in the 2000-01 fiscal year is more than 105% of the amount of federal funds shown
11in the schedule for the appropriations under section 20.395 of the statutes for that
12fiscal year, the secretary of transportation shall include in the plan submitted to the
13joint committee on finance under section 84.03 (2) (b) 1. of the statutes an adjustment
14to the expenditure estimate under section 20.395 (2) (gx) of the statutes that reflects
15an increase in that estimate of $2,000,000.

6of federal funds that the department will expend under section 20.395 of the statutes
7for that fiscal year exceeds 100% of the amount of federal funds shown in the schedule
8for the appropriations under section 20.395 of the statutes for that fiscal year or by
9the amount of $2,000,000, whichever is less.
SB492,3,1410 (d) Notwithstanding section 16.42 (1) (e) of the statutes, in submitting
11information under section 16.42 of the statutes for purposes of the 2001-03 biennial
12budget bill, the department of transportation shall submit information concerning
13the appropriation under section 20.395 (2) (gx) of the statutes as though any change
14in estimated expenditures required by this subsection had not been made.
