AB35,1,3 1An Act to amend 125.07 (1) (a) 3. of the statutes; relating to: the prohibition
2against adults knowingly permitting or failing to take action to prevent the
3illegal consumption of alcohol beverages by underage persons.

Under current law, with certain exceptions, a person who has not reached the
legal drinking age of 21 years (underage person), and who is not accompanied by his
or her parent, guardian, or spouse who has attained the legal drinking age, may not
knowingly possess or consume alcohol beverages. Current law prohibits an adult
from knowingly permitting or failing to take action to prevent the illegal
consumption of alcohol beverages by an underage person on "premises" owned by the
adult or under the adult's control. "Premises" is defined as the area described in a
license or permit for the sale of alcohol beverages.
This bill specifies that an adult may not knowingly permit or fail to take action
to prevent the illegal consumption of alcohol beverages by an underage person on any
property owned by the adult or under the adult's control, regardless of whether the
property is covered by an alcohol beverages license or permit.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1125.07 (1) (a) 3. No adult may knowingly permit or fail to take action to prevent
2the illegal consumption of alcohol beverages by an underage person on premises
3property owned by the adult or under the adult's control. This subdivision does not
4apply to alcohol beverages used exclusively as part of a religious service.
