, section 9156 (2z); relating to: construction of a cogeneration facility at the
3University of Wisconsin-Madison campus and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the board of regents of the University of Wisconsin (UW)
System and the Department of Administration are required to negotiate an
agreement with the public utility, or its affiliate, that provides electric service to the
UW-Madison campus. The agreement must require the public utility or its affiliate
to construct a centralized cogeneration facility at the campus for the purpose of
providing electric, steam, and chilled water services. The cogeneration facility must
have a nominal output of 150 megawatts.
This bill eliminates all of the requirements described above.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB57, s. 1 4Section 1. 20.285 (1) (c) of the statutes is amended to read:
AB57,2,65 20.285 (1) (c) Energy costs. The amounts in the schedule to pay for utilities and
6for fuel, heat, and air conditioning, and to pay costs incurred under ss. 16.858 and

116.895, including all operating costs recommended by the department of
2administration that result from the installation of pollution abatement equipment
3in state-owned or operated heating, cooling, or power plants, by or on behalf of the
4board of regents, and including the cost of purchasing electricity, steam, and chilled
5water generated by the cogeneration facility constructed pursuant to an agreement
6under 2001 Wisconsin Act 109, section 9156 (2z) (b)

AB57, s. 2 7Section 2. 2001 Wisconsin Act 109, section 9156 (2z) is repealed.
