SB299,1,2 1An Act to create 285.63 (11) of the statutes; relating to: prohibiting issuance
2of air pollution control permits for certain ethanol plants.

Current law generally requires a person to obtain an air pollution control
permit from the Department of Natural Resources (DNR) for a stationary source of
air pollution that the person operates or proposes to construct. This bill prohibits
DNR from issuing an air pollution control permit for an ethanol plant located within
five miles of a school.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB299, s. 1 3Section 1. 285.63 (11) of the statutes is created to read:
SB299,1,84 285.63 (11) Restriction on ethanol plants. (a) In this subsection, "school"
5means a public, parochial, or private school that provides an educational program
6for one or more grades between grades 1 and 12 and that is commonly known as an
7elementary school, middle school, junior high school, senior high school, or high
8school.

1(b) The department may not issue an air pollution control permit for an ethanol
2plant located within 5 miles of a school.

SB299,2,54 (1) This act first applies to an ethanol plant for which an air pollution control
5permit application is submitted on the effective date of this subsection.
