SB348,1,2 1An Act to amend 118.51 (3) (c) 1. of the statutes; relating to: attendance in a
2nonresident school district under the Open Enrollment Program.
Analysis by the Legislative Reference Bureau
Under the Open Enrollment Program, a pupil attending public school in a
nonresident school district may continue to attend that school district in succeeding
school years without reapplying, except that the school board of the nonresident
school district may require that the pupil reapply, no more than once, when the pupil
enters middle school, junior high school, or high school.
This bill eliminates this exception.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB348, s. 1 3Section 1. 118.51 (3) (c) 1. of the statutes is amended to read:
SB348,2,34 118.51 (3) (c) 1. If a pupil's parent notifies a nonresident school board, under
5par. (a) 6., that the pupil intends to attend school in that school district in the
6following school year, the pupil may attend that school district in the following school
7year and may continue to attend that school district in succeeding school years

1without reapplying, except that the nonresident school board may require that the
2pupil reapply, no more than once, when the pupil enters middle school, junior high
3school or high school

SB348,2,65 (1) This act first applies to pupils who attend school in a nonresident school
6district under section 118.51 of the statutes during the 2003-04 school year.
