SB412,1,3 1An Act to create 19.42 (7w) (e) and 19.42 (13) (p) of the statutes; relating to:
2coverage of the positions of certain members of governing bodies of state and
3local government retirement systems under codes of ethics for public officials.
Analysis by the Legislative Reference Bureau
Currently, the members of state boards who are appointed to their positions by
the governor, as well as members of certain other specified state boards, are
generally subject to the statutory code of ethics for state public officials. Because the
positions of members of certain boards in the Department of Employee Trust Funds
are appointed by certain other boards or elected by certain groups, these positions
are not subject to the code of ethics for state public officials. Occupants of positions
that are subject to the code must adhere to statutory standards of conduct and must
file annual statements of economic interests with the state ethics board. This bill
provides that the positions of all members of the Employee Trust Funds Board, the
Teachers Retirement Board, and the Wisconsin Retirement Board are subject to the
code of ethics for state public officials.
Currently, the members of local government boards who serve for specified
terms or who are appointed by the administrative head or governing body of a local
government to serve at the pleasure of the appointing authority are generally subject
to the statutory code of ethics for local public officials. Because not all members of
the governing bodies of the Milwaukee city and county retirement systems are
appointed in this manner, not all of these positions are subject to the code of ethics
for local public officials. Occupants of positions that are subject to the code must

adhere to statutory standards of conduct. This bill provides that the positions of all
members of governing bodies of the Milwaukee city and county retirement systems
are subject to the code of ethics for local public officials.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

7retirement board, or the Wisconsin retirement board.
