AB696,1,2 1An Act to amend 173.07 (4) of the statutes; relating to: the issuance of citations

Analysis by the Legislative Reference Bureau
Current law authorizes cities, villages, towns, and counties (political
subdivisions) to use citations to enforce ordinances. A traffic ticket is one example
of a citation. The law provides that citations may be issued by law enforcement
officers. In addition, the governing body of a political subdivision may authorize an
official who is not law enforcement officer to issue citations for violations of
ordinances that are directly related to the official's responsibilities. The official may,
with the approval of the governing body, delegate to employees the authority to issue
citations. Current law also authorizes political subdivisions to appoint humane
officers. A humane officer may issue a citation for the violation of an ordinance
relating to animals if authorized by the appointing political subdivision.
This bill provides that a humane officer may issue a citation on behalf of a
political subdivision only if the humane officer is an employee of the political
subdivision.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
