AB759,1,3 1An Act to create 30.19 (1m) (dm) and 30.20 (1g) (br) of the statutes; relating

exemptions from permit requirements for certain activities affecting
3navigable inland lakes.

Under current law, no person may engage in certain activities affecting
navigable waters without first obtaining a permit from the Department of Natural
Resources. Those activities include the removal of material from the bed of a
navigable lake and the construction, dredging, or enlargement of an artificial water
body that connects with a navigable waterway.
This bill creates an exemption from these permitting requirements for an
activity affecting a navigable inland lake if the activity will not result in the
enlargement of the lake by a specific size and depth.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB759,1,65 30.19 (1m) (dm) An activity affecting a navigable inland lake if all of the
6following apply:
AB759,2,2
11. The activity will not result in an enlargement of the lake by more than 35
2feet landward from the lake's ordinary high-water mark.
AB759,2,43 2. The activity will not result in an enlargement of the lake by an area that is
4more than 2,000 square feet.
AB759,2,65 3. The activity will not result in an enlargement of the lake by a depth exceeding
65 feet below the ordinary high-water mark.
AB759, s. 2 7Section 2. 30.20 (1g) (br) of the statutes is created to read:
AB759,2,108 30.20 (1g) (br) A removal of material is exempt from the permit and contract
9requirements under this subsection for an activity affecting a navigable inland lake
10if all of the following apply:
AB759,2,1211 1. The activity will not result in an enlargement of the lake by more than 35
12feet landward from the lake's ordinary high-water mark.
AB759,2,1413 2. The activity will not result in an enlargement of the lake by an area that is
14more than 2,000 square feet.
AB759,2,1615 3. The activity will not result in an enlargement of the lake by a depth exceeding
165 feet below the ordinary high-water mark.
